Removes reciprocity provision allowing nonresident full- time students to purchase hunting and fishing licenses at resident rates. (8/15/10) AN ACT1 To amend and reenact R.S. 56:104(A)(9) and 302.1(H), relative to nonresident hunting and2 fishing licenses; to remove reciprocity provisions regarding the purchase of hunting3 and fishing licenses; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 56:104(A)(9) and 302.1(H) are hereby amended and reenacted to6 read as follows: 7 §104. License fees; reciprocity; exceptions8 A. No license shall be issued under this Part unless there has been previously9 paid a fee or fees as hereinafter set forth:10 * * *11 (9) Any person who is not a resident of the state of Louisiana but who is a12 full-time student enrolled in an accredited college or university that has a physical13 campus in the state of Louisiana may purchase a nonresident basic hunting license14 for the cost of a resident hunting license as provided in Paragraph (1) of this15 Subsection. The1 provisions of this Paragraph shall apply only to those students who are residents of2 a state that provides to Louisiana residents who are full-time students attending an3 accredited college or university in that state the same option to purchase a license at4 a resident fee. In order to purchase a license under the provisions of this Paragraph,5 the person shall provide to the Department of Wildlife and Fisheries verification of6 his full-time status. Such verification may be provided through the mail. Any person7 hunting under a license issued pursuant to this Paragraph shall also have on his8 person his student identification card which indicates current full-time status.9 * * *10 §302.1. Annual license; temporary license; fees; saltwater fee; exemptions11 * * *12 H. Any person who is not a resident of the state of Louisiana but who is a13 full-time student enrolled in an accredited college or university that has a physical14 campus in the state of Louisiana may purchase a nonresident basic fishing license for15 the cost of a resident fishing license as provided in this Section. In addition, a16 saltwater fishing license may also be purchased for the cost of a resident saltwater17 license. The provisions of this Subsection shall apply only to those students who are18 residents of a state that provides to Louisiana residents who are full-time students19 attending an accredited college or university in that state the same option to purchase20 a license at a resident fee. In order to purchase a license under the provisions of this21 Subsection, the person shall provide to the Department of Wildlife and Fisheries22 verification of his full-time status. DIGEST McPherson (SB 629) Present law allows a nonresident full-time student enrolled in an accredited college or university in Louisiana to purchase a hunting and fishing license at a resident rate. Further provides that those students must be residents of a state that provides Louisiana residents who are full-time students attending an accredited college or university the same option to purchase a license at a resident rate. Proposed law retains present law but removes the reciprocity provision that other states must offer Louisiana students attending an out-of-state college or university the option to purchase a hunting and fishing license at resident rates. Effective August 15, 2010. (Amends R.S. 56:104(A)(9) and 302.1(H))
