SENATE BILL NO. 718

MOTOR VEHICLES. Provides for special permit for bagged rice. (8/15/10) (2/3-

AN ACT1
To enact R.S. 32:387.19, relative to special permits; to authorize issuance of special permits2
for one-way hauls of bagged rice for export within a sixty-mile radius of the Port of3
Lake Charles; to authorize the Department of Transportation and Development to4
promulgate rules and regulations; to provide for limitations; and to provide for5
related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  R.S. 32:387.19 is hereby enacted to read as follows: 8
§387.19. Special permit; bagged rice for export; rules and regulations; Port of9
Lake Charles10
A. Provided there are no written objections raised by the Federal11
Highway Administration, the secretary of the Department of Transportation12
and Development may issue special annual permits for one-way hauls of bagged13
rice for export within a sixty-mile radius of the Port of Lake Charles. These14
special permits shall be issued in accordance with the following provisions:15
(1) The permit shall be issued at the truck permit office of the16
Department of Transportation and Development.17 SB NO. 718

(2) The fee for the permit shall be five hundred dollars annually.1
(3) The permit may authorize the operation of a vehicle or combination2
of vehicles with a total gross vehicle weight not to exceed ninety-five thousand3
pounds.  No tandem axle set equipped with low pressure pneumatic tires shall4
exceed thirty-four thousand pounds on the interstate system or thirty-seven5
thousand pounds off the interstate system.  No tridum axle set equipped with6
low pressure pneumatic tires shall exceed forty-two thousand pounds on the7
interstate system or forty-five thousand pounds off the interstate system.8
(4) The secretary may impose a civil penalty of up to five cents per pound9
for each violation of the weight limit established by this Section.10
B. The secretary may promulgate rules and regulations in accordance11
with the Administrative Procedure Act as are necessary to enforce the12
provisions of this Section.13

Present law establishes maximum vehicle weight limits and provides that the total gross
weight of a vehicle or combination of vehicles may not exceed 80,000 lbs. and the weight
on any single tandem axle may not exceed 34,000 lbs.
Proposed law authorizes the secretary of the Department of Transportation and Development
(DOTD) to issue special annual permits for one-way hauls to trucks transporting bagged rice
for export within a 60-mile radius of the Port of Lake Charles provided no written objections
are raised by the Federal Highway Administration.  The permit authorizes the operation of
a vehicle or combination of vehicles with a total gross vehicle weight not to exceed 95,000.
No tandem axle set equipped with low pressure pneumatic tires shall exceed 34,000 lbs. on
the interstate system and 37,000 lbs. off the interstate system and no tridum axle set
equipped with low pressure pneumatic tires shall not exceed 42,000 lbs. on the interstate
system and 45,000 lbs. off the interstate system.  These special permits shall be issued in
accordance with the following provisions:
(1)The permit shall be issued at DOTD's truck permit office.
(2)The fee for the permit is $500.
(3)The secretary may impose a civil penalty of up to 5¢ per pound for each violation of
the weight limit established by 	proposed law.
Proposed law authorizes the DOTD to promulgate rules and regulations in accordance with
the Administrative Procedure Act as are necessary to enforce the provisions of this Section. SB NO. 718
