Provides for additional pay for certain law enforcement officers. (8/15/11) AN ACT1 To amend and reenact R.S. 33:2002(A)(1) and (4)(a), 2218.2(A)(1) and (2)(a), 2218.8(B)2 and (G) and 2218.10 and to enact Subpart F of Part III of Chapter 6 of Title 40 of the3 Louisiana Revised Statutes of 1950, to be comprised of R.S. 40:1460.3, relative to4 additional pay for certain law enforcement officers; to increase the amount of5 monthly compensation; and to provide for related matters.6 Be it enacted by the Legislature of Louisiana:7 Section 1. R.S. 33:2002(A)(1) and (4)(a), 2218.2(A)(1) and (2)(a), 2218.8(B) and8 (G) and 2218.10 are hereby amended and reenacted to read as follows: 9 §2002. Extra compensation10 A.(1) In addition to the compensation now paid by any municipality, parish,11 fire protection district, or other political subdivision maintaining a fire department,12 or by the Chitimacha Tribe of Louisiana or the Coushatta Tribe of Louisiana,13 hereinafter referred to as "tribe", or by any nonprofit corporation contracting with14 any such political subdivision to provide fire protection services to every paid,15 regularly employed employee who is paid not less than three hundred dollars per16 month, not including supplemental pay, as distinguished from part-time employees17 SB NO. 229 SLS 11RS-464 ENGROSSED Page 2 of 6 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. and volunteers of such fire department, who are carried on the payroll of such fire1 department, and every employee as defined herein who is paid from funds of the2 parish or municipality or tribe obtained through lawfully adopted bond issues,3 lawfully assessed taxes, or other funds available for such purpose, either directly or4 through a board or commission set up by law or ordinance of the parish or5 municipality or tribe, shall be paid extra compensation by the state in the amount of6 five hundred one thousand dollars per month for each such paid employee who has7 completed or who hereafter completes one year of service.8 * * *9 (4)(a) Every fire protection officer who is employed on a full-time basis by10 a port authority headquartered in the city of New Orleans shall be paid by the state11 extra compensation in the amount of five hundred one thousand dollars per month12 in addition to the compensation now paid to him by his employer out of self-13 generated revenue attributable to the agency employing such fire protection officers.14 To be eligible for the extra compensation, each such fire protection officer shall have15 completed one year of service, and any such fire protection officer hired after March16 31, 1986, shall also have completed and passed a certified fireman's training program17 equal to National Fire Protection Association Standard 1001 Firefighter I18 Certification or a firemen's training program as approved by the Louisiana State19 University Firemen Training Program in accordance with R.S. 40:1541 et seq., or20 other state or federally approved maritime firefighter training program.21 * * *22 §2218.2. Rate of compensation; prior service; supplemental monthly compensation;23 police to receive additional compensation24 A.(1) In addition to the compensation now paid by any municipality included25 in this Subpart or by the Chitimacha Tribe of Louisiana, the Coushatta Tribe of26 Louisiana, or the Tunica-Biloxi Tribe of Louisiana, hereinafter referred to as "tribe"27 or "tribal", to any police officer, every police officer employed by any municipality28 or tribe which employs one or more police officers who devotes his full working29 SB NO. 229 SLS 11RS-464 ENGROSSED Page 3 of 6 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. time to law enforcement, and for those hired after March 31, 1986, who have1 completed and passed a council-certified training program as provided in R.S.2 40:2405, shall be paid by the state extra compensation in the amount of five hundred3 one thousand dollars per month for each full-time municipal or tribal law4 enforcement officer who has completed or who hereafter completes one year of5 service.6 (2)(a) Every sworn, commissioned law enforcement officer employed on a7 full-time basis by a bona fide police agency of the state or its political subdivisions,8 other than the Department of Public Safety and Corrections and the Department of9 Wildlife and Fisheries, and headquartered in the city of New Orleans, and who10 serves the welfare of the public in the capacity of a police officer by providing police11 services to the general public through effecting arrests, issuing citations, and serving12 warrants while patrolling levees, waterways and riverfront areas, or while patrolling13 bridges that are within the boundaries of the city of New Orleans shall be paid by the14 state extra compensation in the amount of five hundred one thousand dollars per15 month in addition to the compensation now paid to him by his employer out of16 self-generated revenue attributable to the agency employing such officers. To be17 eligible for the extra compensation, each such law enforcement officer shall have18 completed one year of service, and any such law enforcement officer hired after19 March 31, 1986, shall also have completed and passed a council-certified training20 program, as provided in R.S. 40:2405.21 * * *22 §2218.8. Extra compensation for commissioned full-time deputy sheriffs of all23 parishes24 * * *25 B. Out of the funds appropriated by the legislature for the payment of the26 extra compensation provided by Subsection A of this Section, there shall be27 distributed to the sheriff of each parish monthly to pay additional compensation for28 full-time commissioned deputy sheriffs, and for those hired after March 31, 1986,29 SB NO. 229 SLS 11RS-464 ENGROSSED Page 4 of 6 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. who have completed and passed a council-approved training program as provided1 in R.S. 40:2405 and who are paid a salary of not less than three hundred fifty dollars2 per month, the amount of five hundred one thousand dollars per month for each3 full-time commissioned deputy sheriff at the completion of one year of service.4 * * *5 G. Notwithstanding the provisions of Subsections A and B of this Section,6 any full-time deputy sheriff employed as a field representative or process server and7 who is paid a salary of not less than three hundred fifty dollars per month shall be8 entitled to receive extra compensation in the amount of five hundred one thousand9 dollars per month at the completion of one year of service. However, to be eligible10 for such extra compensation, a field representative or process server shall have11 completed and passed a council-approved training program as provided in R.S.12 40:2405.13 * * *14 §2218.10. Extra compensation for commissioned full-time harbor police, fireboat15 personnel, and bridge police16 In addition to the compensation now paid to any harbor police officer,17 fireboat operator, and bridge police officer, every harbor police officer, fireboat18 employee, and bridge police officer who is a full-time employee and who is paid a19 salary of not less than eight hundred dollars per month and who has completed and20 passed a post-certified training program as provided in R.S. 40:2405 and who has21 completed or who hereafter completes one year of service shall be paid by the state22 extra compensation in the amount of five hundred one thousand dollars per month.23 The provisions of this Section shall only apply to employees of a political24 subdivision of the state.25 Section 2. Subpart F of Part III of Chapter 6 of Title 40 of the Louisiana Revised26 Statutes of 1950, to be comprised of R.S. 40:1460.3, is hereby enacted to read as follows:27 SUBPART F. HAZARDOUS PAY FOR STATE POLICE OFFICERS28 §1457.1. Every sworn, commissioned state police officer, who is a graduate of the1 state police training academy, and who is employed by the office of state police2 of the Department of Public Safety and Corrections shall be paid by the state3 extra compensation for hazardous duty in the amount of five hundred dollars4 per month. DIGEST Marionneaux (SB 229) Present law provides for supplemental pay of $500 per month for firemen, police officers, deputy sheriffs, and full-time deputy sheriffs employed as field representatives or process servers who have completed at least one year of service. Proposed law increases supplemental pay from $500 per month to $1000 per month. Present law provides for supplemental pay of $500 per month for every fire protection officer who has completed at least one year of service and is employed on a full-time basis by a port authority headquartered in a municipality with a population in excess of 450,000. Proposed law increases supplemental pay from $500 per month to $1000 per month. Present law provides for supplemental pay of $500 per month for harbor police officers, fireboat operators, and bridge police officers who have completed at least one year of service. Proposed law increases supplemental pay from $500 per month to $1000 per month. Proposed law provides for additional compensation for hazardous duty in the amount of $500 for state police officers. Effective August 15, 2011.
