Regular Session, 2012 HOUSE BILL NO. 13 BY REPRESENTATIVE TALBOT RETIREMENT/PUBLIC OFFLS: Provides relative to service credit in public retirement systems received by part-time public officials AN ACT1 To amend and reenact R.S. 11:164(B)(1), relative to membership in public retirement2 systems, funds, or plans; to provide relative to certain elected and appointed part-3 time public servants; to provide relative to service credit received by such persons;4 and to provide for related matters.5 Notice of intention to introduce this Act has been published6 as provided by Article X, Section 29(C) of the Constitution7 of Louisiana.8 Be it enacted by the Legislature of Louisiana:9 Section 1. R.S. 11:164(B)(1) is hereby amended and reenacted to read as follows:10 ยง164. Part-time public officials11 * * *12 B.(1)(a) The provisions of Subsection A of this Section shall not apply to13 any person who is serving on January 1, 1997, in any elected or appointed position14 set forth in Subsection A of this Section and who is also a member on January 1,15 1997, of a retirement system covering that position.16 (b) Notwithstanding any provision to the contrary, including a prohibition17 on the reduction of compensation or salary during a term of office, no person18 authorized by Subparagraph (a) of this Paragraph to receive service credit in a public19 retirement system, fund, or plan sponsored by the state of Louisiana or any20 HLS 12RS-111 ORIGINAL HB NO. 13 Page 2 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. instrumentality or political subdivision thereof shall receive service credit in any1 such system, fund, or plan for service after December 31, 2012.2 * * *3 Section 2. This Act shall take effect and become operative if and when the proposed4 amendment of Article X of the Constitution of Louisiana contained in the Act which5 originated as House Bill No. of this 2012 Regular Session of the Legislature is adopted6 at a statewide election to be held in 2012 and becomes effective.7 DIGEST The digest printed below was prepared by House Legislative Services. [R.S. 1:13(B) and 24:177(E)] Talbot HB No. 13 Abstract: Prohibits certain part-time elected officials from continuing to accrue service credit in a public retirement system for their service as part-time elected officials. Present law prohibits a "part-time" elected or appointed official from being a member of a public retirement system based on such service and from receiving service credit for such service unless he was serving in such position on Jan. 1, 1997. Defines "part-time" officials as: (1)Legislators, school board, levee board, policy jury, and parish council members. (2)City council, city-parish council, or town council members, aldermen, and constables. (3)Members of boards or commissions. Present law exempts from this prohibition any person who was serving in one of the enumerated part-time positions on Jan. 1, 1997, and who was a member of a retirement system covering that position. Proposed law provides that no person covered by this exemption shall receive service credit in any such system for service after Dec. 31, 2012. Effective if and when the proposed amendment of Art. X of the Const. of La. contained in the Act which originated as House Bill No. of this 2012 R.S. is adopted at a statewide election and becomes effective. (Amends R.S. 11:164(B)(1))
