Regular Session, 2012 HOUSE BILL NO. 713 BY REPRESENTATIVE HUNTER LAW ENFORCEMENT: Provides with respect to law enforcement checkpoints AN ACT1 To amend and reenact R.S. 32:295.4(introductory paragraph) and to enact R.S. 32:295.4(5),2 relative to law enforcement checkpoints; to require advance notice to the public of3 seat belt and insurance checkpoints; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 32:295.4(introductory paragraph) is hereby amended and R.S.6 32:295.4(5) is hereby enacted to read as follows: 7 ยง295.4. Guidelines for seat belt, motor vehicle inspection sticker, and motor vehicle8 liability security checkpoints; law enforcement agencies ; advance notice9 All law enforcement agencies involved in traffic enforcement shall establish10 guidelines for the operation of seat belt checkpoints ,motor vehicle inspection11 sticker, and proof of compulsory motor vehicle liability security checkpoints. Such12 guidelines shall include but not be limited to the following provisions:13 (1) The location, time, and duration for seat belt and compulsory motor14 vehicle liability security checkpoints shall be established in written form by15 supervisory or other administrative personnel of the law enforcement agency rather16 than the field officers implementing the checkpoint.17 (2) Provision for advance warning to the approaching motorists with signs,18 flares, and other indications to warn motorists of an impending stop and to provide19 indication of its official nature as a police checkpoint.20 HLS 12RS-1375 ENGROSSED HB NO. 713 Page 2 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions.
