AN ACT1
To amend and reenact R.S. 15:571.3(B)(1)(a), relative to diminution of sentence for good2
behavior; to change the rate that diminution of sentence is calculated for certain3
offenders; to provide for applicability; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 15:571.3(B)(1)(a) is hereby amended and reenacted to read as6
follows: 7
ยง571.3.  Diminution of sentence for good behavior8

B.(1)(a)  Unless otherwise prohibited, every inmate in the custody of the10
department who has been convicted of a felony, except an inmate convicted a second11
time of a crime of violence as defined by R.S. 14:2(B), and sentenced to12
imprisonment for a stated number of years or months, may earn, in lieu of incentive13
wages, a diminution of sentence by good behavior and performance of work or14
self-improvement activities, or both, to be known as "good time".  Those inmates15
serving life sentences will be credited with good time earned which will be applied16
toward diminution of their sentences at such time as the life sentences might be17
commuted to a specific number of years.  The secretary shall establish regulations18
for awarding and recording of good time and shall determine when good time has19
been earned toward diminution of sentence. The amount of diminution of sentence20
allowed under the provisions of this Section shall be at the rate of thirty-five days for21
every thirty days one and one half-day for every one day in actual custody served on22

sentencing for the particular sentence imposed as authorized by the provisions of1
Code of Criminal Procedure Article 880.2

Section 2. The provisions of this Act shall only apply to those persons sentenced on4
or after August 1, 2012.5
