AN ACT1
To amend and reenact R.S. 33:9106.2(B)(1), (C) and (D), relative to the Orleans Parish2
Communication District; to provide for fixed rate service charges relative to 9-1-13
emergency calls; to provide for local elections; and to provide for related matters.4
Notice of intention to introduce this Act has been published.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 33:9106.2(B)(1), (C) and (D) are hereby amended and reenacted to7
read as follows: 8
ยง9106.2. Fixed rate service charge; Orleans Parish9

B.(1) Notwithstanding any other law to the contrary, the governing authority11
of the Orleans Parish Communication District may, by a majority vote, by favorable12
vote of a majority of the members of the governing authority voting on the13
motion, a quorum being present, establish a fixed rate emergency telephone14
service charge for 9-1-1 services. The fixed rate emergency telephone service15
charges shall be collected and remitted in the same manner as service charges are16
currently collected.17
(a) Such service charges shall not exceed the following amounts:18
(a)(i) One dollar per exchange access line serving residential service users.19
(b) (ii) Two dollars per exchange access line serving commercial service20
users (not to exceed one hundred lines per user).21
(b) Notwithstanding the provisions of Subparagraph (a) of this22
Paragraph, such service charges shall not exceed the following amounts if23
approved by the electors as provided in Subsection D of this Section:24

(i) Two dollars per exchange access line serving residential service users.1
(ii) Three dollars per exchange access line serving commercial service2
users (not to exceed one hundred lines per user).3
(iii) One dollar and twenty-six cents per month per wireless commercial4
mobile radio service connection.5
(iv) Two dollars per month per residential interconnected voice over6
Internet protocol service access line equivalent.7
(v) Three dollars per month per commercial interconnected voice over8
Internet protocol service access line equivalent.9
(c) For purposes of this Paragraph:10
(i) "Interconnected voice over Internet protocol service" shall have the11
meaning provided in CFR Title 47, Section 9.3.12
(ii) "Access line equivalent" shall mean each telephone number issued13
to a voice over Internet protocol customer. However, if the telephone numbers14
issued to a customer exceed the available capacity for simultaneous outward15
calls to be connected to the public switched telephone network, the access line16
equivalent shall be equal to the capacity for simultaneous outward calls to the17
public switched telephone network.18

C.  If such service charges are levied on a flat fee schedule of fixed rates,20
rates shall be uniform for each of the following classes of service:21
(1) Exchange access line serving residential service users.22
(2) Exchange access line serving commercial service users.23
(3) Cellular, commercial mobile radio service (CMRS), or other wireless24
telecommunication service users at the rate for such users provided in Part25
I of Chapter 31 of Title 33 of the Louisiana Revised Statutes of 1950.26
D. Notwithstanding R.S. 33:9108(E), the authority for the Orleans Parish27
Communication District to levy and collect a fixed rate emergency telephone service28
charge pursuant to this Part shall continue on and after December 31, 2009.29

governing authority, by favorable vote of a majority of the members of the1
governing authority voting on the motion, a quorum being present, reestablish2
the original emergency telephone service charge in effect prior to August 15, 2006,3
upon which the district may no longer levy and collect the fixed rate emergency4
service charge for 911 services authorized by this Section.5
D.(1) No service charge imposed pursuant to Subparagraph (B)(1)(b) of6
this Section shall become effective unless approved by the favorable vote of a7
majority of the electors of the district voting on the proposition at an election8
held for such purpose.9
(2) Monies collected pursuant to Subparagraph (B)(1)(b) of this Section10
by the Orleans Parish Communications District shall be made available to such11
district and shall not be diverted for use by any other entity or for any purposes12
other than those served by such district.13
