BOATS/BOATING. Provides for the regulation of air boats in St. Charles Parish.  (8/1/12)
AN ACT1
To amend and reenact R.S. 34:851.27(B)(9), relative to the regulation of air boats; to2
authorize St. Charles Parish and its municipalities to regulate the operation of air3
boats; to provide terms, conditions, and requirements; and to provide for related4
matters.5
Notice of intention to introduce this Act has been published.6
Be it enacted by the Legislature of Louisiana:7
Section 1. R.S. 34:851.27(B)(9) is hereby amended and reenacted to read as follows:8

(9) Notwithstanding any provision of law to the contrary, the governing13
authority of Jefferson and St. Charles Parish parishes and its their municipalities14
shall have the authority to regulate the operation of air boats within the such parish.15
This authority shall extend to the establishment of minimum requirements for16
commercial or recreational use, including equipment, speed limits, issuing air boat17 SB NO. 648

permits and inspection, providing for licenses and air boat permit fees, defining1
violations and assessing penalties, and other requirements. The regulations shall be2
enforced by the sheriff and local law enforcement officers and may be enforced by3
state police or commissioned wildlife agents and those officers who shall have the4
power to make arrests for purposes of such enforcement. Any regulations or5
requirements established pursuant to this Paragraph shall not be less stringent or6
impair the authority of the Department of Wildlife and Fisheries provided for in R.S.7
34:851.1 et seq. Any such regulations shall be specifically limited in effect to8
operation of an air boat in Jefferson Parish or St. Charles Parish and shall not be9
deemed to affect the validity or invalidity of operation of an air boat in any other10
parish.11

Present law provides that the governing authorities of Jefferson Parish and its municipalities
shall have the authority to regulate the operation of air boats within the parish, which
includes the establishment of minimum requirements for commercial or recreational use,
including equipment, speed limits, issuing air boat permits and inspection, providing for
licenses and air boat permit fees, defining violations and assessing penalties, and other
requirements.
Proposed law adds St. Charles Parish and its municipalities to the list of parishes that can
regulate the operation of air boats.
Effective August 1, 2012.
