FISHING/RECREATIONAL: Removes possession limits for freshwater recreational
fishing on Toledo Bend Reservoir
AN ACT1
To amend and reenact R.S. 56:325(B) and (C) and to repeal R.S. 56:325(A)(11)(b), relative2
to recreational fishing; to remove possession limits for recreational fishing on Toledo3
Bend Reservoir; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 56:325(B) and (C) are hereby amended and reenacted to read as6
follows:7
ยง325.  Daily take , possession, and size limits; freshwater recreational fish8

B.  No Except as otherwise provided in this Subsection and in Paragraph10
(A)(11) of this Section, no person shall have in his possession more than twice the11
number of fish specified in any paragraph of Subsection A. , except those specified12
in Paragraph (11). No person shall possess in excess of the limits specified in13
Paragraph (A)(11) of Subsection A this Section.  However, there shall be no14
possession limit for fish caught on Toledo Bend Reservoir for recreational purposes15
by a person possessing a recreational fishing license.16
C. Notwithstanding any other provision of law to the contrary, the17
commission may amend by rule, in accordance with the Administrative Procedure18
Act, size limits, daily take limits, possession limits, seasons, and times set by law for19 HLS 13RS-53	ORIGINAL

freshwater recreational fish. Such limits, seasons, and times may vary between and1
among waterbodies based on biological data or for purposes of research or2
experimentation. However, the commission shall not amend by rule the provisions3
of Subsection B of this Section which apply to possession limits for fish caught on4
Toledo Bend Reservoir.5
Section 2.  R.S. 56:325(A)(11)(b) is hereby repealed in its entirety.6

Abstract: Repeals possession limits for freshwater recreational fish caught on Toledo Bend
Reservoir.
Present law provides daily take limits and possession limits for freshwater recreational
fishing. The possession limits are two times the daily take limits.  Further authorizes the
Wildlife and Fisheries Commission to amend by rule size limits, daily take limits, possession
limits, seasons, and times.
Proposed law removes the possession limits for recreational fishing on Toledo Bend
Reservoir.
