HOUSE CONCURRENT RESOLUTI ON NO. 113

MEDICAID: Requests a study of the most effective means by which to implement federally
authorized cost sharing measures in the La. Medicaid program
A CONCURRENT RESOLUTI ON1
To authorize and request the Department of Health and Hospitals to study the most effective2
means by which to implement federally authorized medical assistance cost sharing3
measures in the Medicaid program of this state and to report its findings to the4
legislative committees on health and welfare.5
WHEREAS, Medicaid constitutes the largest single programmatic item in the budget6
of this state; and 7
WHEREAS, the system of funding for the Medicaid program as currently structured8
is unsustainable, and cost containment in this major assistance program is an urgent priority;9
and10
WHEREAS, in preliminary rules published in January 2013, the Centers for11
Medicare and Medicaid Services of the United States Department of Health and Human12
Services proposed "to update and simplify the complex Medicaid premiums and cost sharing13
requirements to promote the most effective use of services and to assist states in identifying14
cost sharing flexibilities" (78 Fed. Reg. 4595 (January 22, 2013)); and15
WHEREAS, the rule defines "cost sharing" as "any copayment , coinsurance,16
deductible, or other similar charge"; and17
WHEREAS, the Legislature of Louisiana finds that cost containment measures in the18
Medicaid program are essential means for enhancing the efficiency and effectiveness of19
health care delivered to the population served by the program.20 HLS 13RS-772	ENGROSSED

THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby1
authorize and request the Department of Health and Hospitals to study the most effective2
means by which to implement federally authorized medical assistance cost sharing measures3
in the Medicaid program of this state.4
BE IT FURTHER RESOLVED that, in conducting the study, the department may5
engage, collaborate with, and obtain information and perspective from providers,6
stakeholders, and other groups with an interest or expertise in Medicaid financing and cost7
containment.8
BE IT FURTHER RESOLVED that the report shall consider and make9
recommendations concerning policies which allow a provider to impose cost sharing as a10
condition for delivering treatment.11
BE IT FURTHER RESOL VED that the report shall consider and make12
recommendations concerning minimization of the administrative and financial impact of cost13
sharing requirements on the department and on health care providers.14
BE IT FURTHER RESOLVED that the report shall consider and make15
recommendations concerning cost sharing policies which promote better health outcomes16
by encouraging utilization of preventive and cost-effective services while discouraging17
utilization of uncessary high-cost services.18
BE IT FURTHER RESOLVED that the department shall provide the findings of this19
study in the form of a written report to the House Committee on Health and Welfare and the20
Senate Committee on Health and Welfare by February 1, 2014, or within six months of the21
date that the final federal rule pursuant to the January 2013, preliminary rule is published,22
whichever is later.23
BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the24
