AN ACT1
To enact R.S. 38:2212.1(N), relative to group purchasing of school materials, equipment,2
and supplies; to authorize public school districts and public schools to participate in3
a purchasing cooperative for the purchase of school materials, equipment, and4
supplies; to provide for definitions; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 38:2212.1(N) is hereby enacted to read as follows:7

N.(1) Notwithstanding any provision of this Part to the contrary, any public11
school district or public school may participate in a school district purchasing12
cooperative for the purchase of materials, equipment, and supplies.13
(2) Public schools and public school districts which are members of a school14
district purchasing cooperative may purchase materials, equipment, and supplies in15
accordance with contracts submitted to the school district purchasing cooperative by16
a vendor.17
(3) As used in this Subsection, "school district purchasing cooperative"18
means an organization, whether for profit or not for profit, of which two or more19
public school districts are members and which solicits proposals or bids from20
vendors of services, materials, equipment, or supplies of the type and nature as may21
be purchased by a public school district or public school.22 ENROLLEDHB NO. 690

(4) A school district purchasing cooperative shall use the following request1
for proposals process in the solicitation of vendors for materials, equipment, and2
supplies:3
(a) Public notice shall be given by the placement of an advertisement in the4
official journal of the state at least once. Advertisements may also be placed in other5
newspapers, trade journals, and websites at the discretion of the cooperative.6
(b) The notice shall include the nature of the materials, equipment, or7
supplies sought and may include information on the estimated quantity sought and8
the time frame for purchase by the members of the cooperative.9
(c) The advertisement shall appear at least fifteen days before the last day10
that proposals may be submitted.11
(d) The notice shall be provided at least fifteen days before the last day for12
proposals to be accepted to persons, firms, or companies that have requested to be13
notified of requests for proposals.14
(e) The notice shall include information with regard to the deadline for15
submission of proposals and contact information for questions concerning the16
solicitation.17
(f) The responsible and responsive proposal that provides the lowest price18
shall be selected.19
(g) The selected vendor shall agree to make the subject materials, equipment,20
or supplies available for the price set forth in the proposal to any member of the21
school district purchasing cooperative.22
