HLS 14RS-265 REENGROSSED Page 1 of 2 Regular Session, 2014 HOUSE RESOLUTION NO. 10 BY REPRESENTATIVE TERRY LANDRY TRANSPORTATION DEPT: Requests the House Committee on Transportation to study the Louisiana Department of Transportation and Development's Disadvantaged Business Enterprise Program to determine if the department's contracting activities are in line with the program's objectives based on local market place conditions A RESOLUTION1 To urge and request the House Committee on Transportation, Highways, and Public Works2 to study the Louisiana Department of Transportation and Development's3 Disadvantaged Business Enterprise program.4 WHEREAS, the Louisiana Department of Transportation and Development has5 developed a Unified Certification Program, as required by 49 CFR Part 26.81 of the United6 States Department of Transportation, to certify businesses qualified as a Disadvantaged7 Business Enterprise (DBE); and8 WHEREAS, DBEs are for-profit small businesses where socially and economically9 disadvantaged individuals own at least a fifty-one percent interest and also control10 management and daily business operations; and11 WHEREAS, a DBE program was created to remedy past and current discrimination12 against socially and economically disadvantaged individuals wanting to do business with the13 Louisiana Department of Transportation and Development on federally assisted projects; and14 WHEREAS, the Louisiana Department of Transportation and Development is15 responsible for certifying the eligibility of DBE firms to participate in United States16 Department of Transportation contracts and establish narrowly-tailored goals for the17 participation of disadvantaged entrepreneurs; and 18 HLS 14RS-265 REENGROSSED HR NO. 10 Page 2 of 2 WHEREAS, the United States Department of Transportation's DBE program1 provides a vehicle for increasing the participation of minority-owned small businesses in2 state and local contract procurement. 3 THEREFORE, BE IT RESOLVED that the House of Representatives of the4 Legislature of Louisiana does hereby urge and request the House Committee on5 Transportation, Highways, and Public Works to study the Unified Certification Program of6 the Louisiana Department of Transportation and Development to ensure the department's7 contracting and certification activities follow the program's objectives based on local market8 place conditions.9 BE IT FURTHER RESOLVED that a final report of the committee's findings and10 recommendations shall be submitted to the House of Representatives no later than January11 1, 2015.12 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the13 Secretary of the Louisiana Department of Transportation and Development.14 DIGEST The digest printed below was prepared by House Legislative Services.
