JUDGES.  Provides relative to powers of the Judiciary Commission. (8/1/14)
AN ACT1
To amend and reenact R.S. 13:36, relative to the Judiciary Commission; to provide relative2
to the powers of the commission; to provide relative to any investigation or hearing3
held by the commission; to provide relative to discovery; and to provide for related4
matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 13:36 is hereby amended and reenacted to read as follows:7
ยง36.  Powers of commission8
A. In the course of any investigation or hearing held by the commission, it9
may administer oaths or affirmations, subpoena witnesses, compel their attendance,10
examine them under oath or affirmation, and require the production of books,11
records, documents, or other evidence deemed relevant or material to the12
investigation or hearing.13
B. The provisions governing discovery as set forth in the Code of Civil14
Procedure and Code of Criminal Procedure shall apply to any investigation or15
hearing held pursuant to this Section.16 SB NO. 628

Present law provides that in the course of any investigation or hearing held by the
commission, it may administer oaths or affirmations, subpoena witnesses, compel their
attendance, examine them under oath or affirmation, and require the production of books,
records, documents, or other evidence deemed relevant or material to the investigation or
hearing. 
Proposed law provides that the discovery rules of the Code of Civil Procedure and Code of
Criminal Procedure shall apply to any investigation or hearing held pursuant to proposed
law.
Effective August 1, 2014.
