HOUSE BILL NO. 174
BY REPRESENTATIVE LEBAS AND SENATOR JOHNS
1	AN ACT
2 To amend and reenact R.S. 40:978(E), enact R.S. 40:964(Schedule IV)(A)(3) and (B)(45.5)
3 and to repeal R.S. 40:964(Schedule III)(D)(1)(c) and (d), relative to the Uniform
4 Controlled Dangerous Substances Law; to add certain substances to Schedules I and
5 IV; to provide with respect to classifications in Schedule III; to reschedule certain
6 products containing hydrocodone; and to provide for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 40:978(E) is hereby amended and reenacted and R.S.
9 40:964(Schedule IV)(A)(3) and (B)(45.5) are hereby enacted to read as follows:
10 §964.  Composition of schedules
11	Schedules I, II, III, IV, and V shall, unless and until added to pursuant to R.S.
12 40:962, consist of the following drugs or other substances, by whatever official
13 name, common or usual name, chemical name, or brand name designated:

16	A.  Narcotic drugs

18	(3)  Tramadol (2-[(dimethylamino)methyl]-1-(3-methoxyphenyl)
19 cyclohexanol), its salts, isomers, and salts of its isomers.

1	B.  Depressants
2	Unless specifically excepted or unless listed in another schedule, any
3 material, compound, mixture, or preparation containing any quantity of the following
4 substances, including its salts, isomers, and salts of isomers, whenever the existence
5 of such salts, isomers, and salts of isomers is possible within the specific chemical
6 designation:

10 §978.  Prescriptions 
11	*          *          *
12	E.(1)  The pharmacist shall not dispense more than a ten-day supply at a
13 dosage not to exceed the United States Food and Drug Administration's approved
14 labeling for the medication if the prescriber for such medication is not licensed by
15 the state of Louisiana, and the medication is an opiod opioid derivative Schedule II
16 or an opiod opioid derivative Schedule III controlled dangerous substance. The
17 dispensing pharmacist shall notify the prescriber of the supply dispensed and the
18 cancellation of the remainder of the prescription.
19	(2)  Within sixty days of the dispensing of a medication pursuant to
20 Paragraph (1) of this Subsection, such a medication shall not be dispensed again for
21 the individual by a prescriber not licensed by the state of Louisiana.
22	(3)  The provisions of this Subsection shall not apply if the prescription
23 monitoring information from the state of the prescriber may be viewed by the
24 dispensing pharmacist.

26 Section 2.  R.S. 40:964(Schedule III)(D)(1)(c) and (d) are hereby repealed in their
27 entirety.
28 Section 3.  This Act shall become effective upon signature by the governor or, if not
29 signed by the governor, upon expiration of the time for bills to become law without signature
30 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If

1 vetoed by the governor and subsequently approved by the legislature, this Act shall become
2 effective on the day following such approval.
