LEGISLATIVE AGCY/LAW INST: Directs the La. State Law Institute to reorganize and
recodify the Miscellaneous Health Provisions chapter of Title 40 of the La. Revised
Statutes
1 A CONCURRENT RESOL UTION
2To authorize and direct the Louisiana State Law Institute to reorganize and recodify the
3 Miscellaneous Health Provisions Chapter of Title 40 of the Louisiana Revised
4 Statutes of 1950 in accordance with the specifications provided in this Resolution.
5 WHEREAS, Chapter 5 of Title 40 of the Louisiana Revised Statutes of 1950, entitled
6"Miscellaneous Health Provisions", is presently comprised of eighty-nine parts of law, the
7majority of which are unrelated to each other; and
8 WHEREAS, these provisions can be termed "miscellaneous" only by virtue of their
9inclusion within a single chapter of law; and
10 WHEREAS, this Chapter of law is no longer organized in an intentional manner; and
11 WHEREAS, the absence of a logical system of order in this Chapter perpetuates the
12problem of disorganization in an area of law that has come to encompass many high-profile
13and frequently revised statutes.
14 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby
15authorize and direct the Louisiana State Law Institute to reorganize and recodify the
16Miscellaneous Health Provisions Chapter of Title 40 of the Louisiana Revised Statutes of
171950.
18 BE IT FURTHER RESOLVED that the Louisiana State Law Institute shall effect the
19reorganization and recodification of the Chapter in accordance with the following
20instructions:

Authorizes and directs the La. State Law Institute to reorganize and recodify the
Miscellaneous Health Provisions Chapter of Title 40 (Public Health and Safety) of present
law (R.S. 40:1061-1300.426) in accordance with the recodification plan proposed in this
Resolution.
Proposed recodification plan creates eight chapters from the provisions of the present
Miscellaneous Health Provisions Chapter (Chapter 5 of Title 40), to be numbered, entitled,
and comprised as follows:
Chapter 5.Health Provisions: Abortion

Chapter 5-A.Health Provisions: Children
Comprising R.S. 40:1071-1087.5
Chapter 5-B.Health Provisions: Diseases
Comprising R.S. 40:1101-1119.24

Comprising R.S. 40:1131-1139.11
Chapter 5-D.Health Provisions: Health Care
Comprising R.S. 40:1151-1237.4
Chapter 5-E.Health Provisions: Medical Assistance Program (Medicaid)
Comprising R.S. 40:1241-1253.5
Chapter 5-F.Health Provisions: Public Health
Comprising R.S. 40:1261-1293.2
Chapter 5-G.Miscellaneous Health Provisions

Directs the La. State Law Institute to change references to Sections, Chapters, Subchapters,
Parts, and Subparts throughout present law as necessary to reflect segments of law that have
been changed, added, and deleted through the recodification plan proposed in this
Resolution.
