2015 Regular Session ENROLLED SENATE BILL NO. 87 BY SENATOR PERRY Prefiled pursuant to Article III, Section 2(A)(4)(b)(i) of the Constitution of Louisiana. 1 AN ACT 2 To enact R.S. 42:1121(I) and 1124.2.1(D)(1)(b)(vi), and to repeal R.S. 42:1121(I), relative 3 to ethics, to provide relative to financial disclosure requirements of members of 4 boards and commissions; to provide an exception for members of certain boards and 5 commissions; to provide an exception to the post-service restrictions in the Code of 6 Governmental Ethics to allow certain contracts by a former member of the East 7 Union Parish Hospital Service District and related legal entities; to provide for 8 subsequent repeal of such exception; and to provide for related matters. 9 Be it enacted by the Legislature of Louisiana: 10 Section 1. R.S. 42:1121(I) and 1124.2.1(D)(1)(b)(vi) are hereby enacted to read as 11 follows: 12 §1121. Assistance to certain persons after termination of public service 13 * * * 14 I. Nothing in this Section shall prohibit a former member of the board 15 of commissioners of the East Union Parish Hospital Service District or a legal 16 entity owned by such former member from entering into a contract with or 17 under the supervision or jurisdiction of board of commissioners of the East 18 Union Parish Hospital Service District or Union General Hospital or receiving 19 compensation pursuant to such contract. 20 * * * 21 §1124.2.1. Financial disclosure; members of boards and commissions 22 * * * 23 D. SB NO. 87 ENROLLED 1 (1) 2 * * * 3 (b) "Board or commission" shall not mean: 4 * * * 5 (vi) Any board or commission that does not have the authority to 6 expend, disburse, or invest more than fifty thousand dollars of funds in a fiscal 7 year and whose members are not eligible to receive any compensation, per diem, 8 or reimbursement of expenses for service on the board or commission. 9 * * * 10 Section 2. R.S. 42:1121(I) as enacted by the provisions of Section 1 of this Act is 11 hereby repealed in its entirety. 12 Section 3.(A) The provisions of this Section and of Section 1 of this Act shall 13 become effective upon signature of this Act by the governor or, if not signed by the 14 governor, upon expiration of the time for bills to become law without signature by the 15 governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If this Act 16 is vetoed by the governor and subsequently approved by the legislature, this Section and 17 Section 1 of this Act shall become effective on the day following such approval. 18 (B) Section 2 of this Act shall become effective on July 1, 2017.
