HOUSE BILL NO. 854

MOTOR VEHICLES:  Provides relative to types of motor vehicles that are required to be
covered by an automobile liability policy pursuant to the Compulsory Motor Vehicle
Liability Security Law
1	AN ACT
2To amend and reenact R.S. 32:861(A)(1), relative to motor vehicle insurance; to provide for
3 an expansion of the types of vehicles covered under the Compulsory Motor Vehicle
4 Liability Security Law; and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 32:861(A)(1) is hereby amended and reenacted to read as follows: 
7 ยง861.  Security required
8	A.(1)  Every self-propelled motor vehicle required to be registered in this
9 state and that is designed for use on public highways, except for those motor vehicles
10 used as agricultural or forest vehicles during seasons when they are not used on the
11 highway, those used primarily for exhibit or kept primarily for use in parades,
12 exhibits, or shows, and lease-bound mobile rig haulers as defined in Subsection D
13 of this Section, shall be covered by an automobile liability policy with liability limits
14 as defined by R.S. 32:900(B)(2) or 900(M), or a binder for same, or by a motor
15 vehicle liability bond as defined by Subsection B of this Section, or by a certificate
16 of the state treasurer stating that cash or securities have been deposited or securitized
17 with said treasurer as provided by Subsection C of this Section, or by a certificate of
18 self-insurance as provided by R.S. 32:1042.

Abstract:  Removes the compulsory motor vehicle liability security exception applicable
to motor vehicles used as agricultural or forest vehicles during certain times, and
motor vehicles used for exhibit or for use in parades, exhibits, or shows.
Present law provides that every self-propelled motor vehicle registered in this state, except
those motor vehicles used as agricultural or forest vehicles during seasons when they are not
used on the highway, those used primarily for exhibit or kept primarily for use in parades,
exhibits, or shows, and lease-bound mobile rig haulers, shall be covered by an automobile
liability policy with certain liability limits.
Proposed law provides that the self-propelled motor vehicles required to be covered by an
automobile liability policy with certain liability limits referenced in present law are those
motor vehicles required to be registered in this state and that are designed for use on public
highways, subject to the exceptions in present law.

1. Restore present law which exempts those motor vehicles used as agricultural or
forest vehicles during seasons when they are not used on the highway, those used
primarily for exhibit or kept primarily for use in parades, exhibits, or shows from
being covered by an automobile liability policy with certain liability limits.
