HLS 16RS-1578 ORIGINAL 2016 Regular Session HOUSE BILL NO. 943 BY REPRESENTATIVE LEOPOLD FISCAL CONTROLS: Prohibits the filling of vacant employment positions and the creation of new employment positions in state government until after June 30, 2018 1 AN ACT 2To enact R.S. 39:85.1 and to repeal R.S. 39:85.1, relative to the filling of positions in state 3 government; to prohibit the filling of vacant positions during a certain time period; 4 to prohibit the creation of new positions for a certain time period; to remove such 5 provisions; and to provide for related matters. 6Be it enacted by the Legislature of Louisiana: 7 Section 1. 39:85.1 is hereby enacted to read as follows: 8 ยง85.1. Prohibition on filling vacant positions and creating new positions 9 A. No agency as defined in R.S. 39:2 or agent of such an agency shall fill a 10 vacant employment position in the executive branch of state government or create 11 a new employment position in the executive branch of state government. 12 B. No house, official, committee, employee, or other entity or agent of the 13 legislative branch of state government shall fill a vacant employment position in the 14 legislative branch of state government or create a new employment position in the 15 legislative branch of state government. 16 C. No court, judge, official, employee, or other entity or agent of the judicial 17 branch of state government shall fill a vacant employment position in the judicial 18 branch of state government or create a new employment position in the judicial 19 branch of state government. The provisions of this Section shall be inapplicable, inoperative, and of 2 no effect after June 30, 2018. 3 Section 2. R.S. 39:85.1 is hereby repealed in its entirety. 4 Section 3.(A) The provisions of Section 1 of this Act and of this Section shall 5become effective on July 1, 2016. 6 (B) The provisions of Section 2 of this Act shall become effective on July 1, 2018. Proposed law prohibits any agency as defined in present law (R.S. 39:2) or agent of such an agency from filling a vacant employment position in the executive branch of state government or creating a new employment position in the executive branch of state government. Present law defines "agency" as any state office, department, board, commission, institution, division, officer or other person, or functional group, heretofore existing or hereafter created, that is authorized to exercise, or that does exercise, any functions of the government of the state in the executive branch, but not any governing body or officer of any local government or subdivision of the state, or any parochial officer who exercises functions coterminous with the municipality in which he performs those functions. Proposed law prohibits any house, official, committee, employee, or other entity or agent of the legislative branch of state government from filling a vacant employment position in the legislative branch of state government or creating a new employment position in the legislative branch of state government.
