HLS 16RS-1578 ENGROSSED 2016 Regular Session HOUSE BILL NO. 943 BY REPRESENTATIVE LEOPOLD FISCAL CONTROLS: Prohibits the creation of new employment positions in state government from August 1, 2016, through June 30, 2018 1 AN ACT 2To enact R.S. 39:85.1 and to repeal R.S. 39:85.1, relative to the filling of positions in state 3 government; to prohibit the creation of new positions for a certain time period; to 4 remove such provisions; and to provide for related matters. 5Be it enacted by the Legislature of Louisiana: 6 Section 1. 39:85.1 is hereby enacted to read as follows: 7 ยง85.1. Prohibition on creating new positions 8 A.(1) Except as provided in Paragraph (2) of this Subsection, no agency as 9 defined in R.S. 39:2 or agent of such an agency shall create a new employment 10 position in the executive branch of state government. 11 (2) Institutions of higher education and their management boards shall be 12 exempt from the provisions of this Subsection. 13 B. No house, official, committee, employee, or other entity or agent of the 14 legislative branch of state government shall create a new employment position in the 15 legislative branch of state government. 16 C. The provisions of this Section shall be inapplicable, inoperative, and of 17 no effect after June 30, 2018. 18 Section 2. R.S. 39:85.1 is hereby repealed in its entirety. 19 Section 3.(A) The provisions of Section 1 of this Act and of this Section shall 20become effective on August 1, 2016. Proposed law prohibits any agency as defined in present law (R.S. 39:2) or agent of the agency from creating a new employment position in the executive branch of state government. Proposed law exempts institutions of higher education and their management boards from the prohibition. Present law defines "agency" as any state office, department, board, commission, institution, division, officer or other person, or functional group, heretofore existing or hereafter created, that is authorized to exercise, or that does exercise, any functions of the government of the state in the executive branch, but not any governing body or officer of any local government or subdivision of the state, or any parochial officer who exercises functions coterminous with the municipality in which he performs those functions. Proposed law prohibits any house, official, committee, employee, or other entity or agent of the legislative branch of state government from creating a new employment position in the legislative branch of state government. Proposed law provides that the provisions of proposed law shall be inapplicable, inoperative, and of no effect after June 30, 2018. Effective August 1, 2016; except repeal of proposed law effective July 1, 2018.
