INSURANCE POLICIES.  Requires insurance for persons handling explosives. (8/1/16)
1	AN ACT
2 To enact R.S. 40:1472.3(F), relative to licensing a manufacturer, dealer-distributor, user,
3 blaster, or handler of explosives; to provide for the requirement of liability insurance
4 as a condition for obtaining a license; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 40:1472.3(F) is hereby enacted to read as follows: 
7 ยง1472.3. License; manufacturer, dealer-distributor, user, blaster, or handler of
8	explosives

10	F. No license shall be issued by the deputy secretary pursuant to an
11 application therefor when the applicant is in control of demilitarized explosives,
12 propellants, and recycled bomb materials in excess of one-half million pounds
13 or more unless the applicant provides proof of liability insurance. The liability
14 insurance shall be in an amount not less than fifty million dollars and shall
15 provide coverage for damage caused by blast waves, blast wind, fire,
16 fragmentation, open burning, secondary fragmentation, shockwaves and stress
17 waves which result from the handling, movement, use, manipulation, or other

1 action causing the detonation of explosives by the applicant or an employee or
2 agent of the applicant.

Present law provides for the requirements of a manufacturer, dealer-distributor, user, blaster,
or handler of explosives to obtain a state-issued license.
Proposed law retains present law and adds the requirement of proof of a $50 million liability
insurance policy to cover damage caused by blast waves, blast wind, fire, fragmentation,
open burning, secondary fragmentation, shockwaves and stress waves as a condition of
issuance of a license when the applicant is in control of demilitarized explosives, propellants,
and recycled bomb materials in excess of one-half million pounds or more.
Effective August 1, 2016.
