HOUSE BILL NO. 3
BY REPRESENTATIVE HENRY AND SENATOR THOMPSON
1	AN ACT
2 To appropriate funds and to make and otherwise provide for certain reductions in
3 appropriations from certain sources to be allocated to designated agencies and
4 purposes in specific amounts for the making of supplemental appropriations and
5 reductions for said agencies and purposes for the 2016-2017 Fiscal Year; to provide
6 for an effective date; and to provide for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1.A.  The commissioner of administration is authorized and directed to
9 reduce the State General Fund (Direct) appropriations contained in Act 17 of the 2016
10 Regular Session of the Legislature for the following agencies in the following amounts:

20 Provided, however, that the reductions to the Medical Vendor Payments program shall not
21 reduce the payments for waiver services and Applied Behavioral Analysis rates.
22 Provided, further, that of the reductions to Schedule 09-306 Medical Vendor Payments
23 authorized herein any reductions in payments to rural hospitals or public private partnership
24 hospitals implemented by the department shall be applied to both hospital groups at the rate
25 of 0.99% of the total of such payments to that group of hospitals.

38 education agencies and other public schools.  Additionally, no appropriations from the
39 Louisiana Quality Education Support Fund or federal funds for the foregoing activities shall
40 be reduced.
41 Section 1.B.  The commissioner of administration is authorized and directed to
42 reduce the State General Fund by Statutory Dedications appropriations contained in Act 17
43 of the 2016 Regular Session of the Legislature for the following agencies in the following

31 Legislature for the vacancies in state government, excluding vacancies in higher education,
32 funded through that Act by $11,900,000.  In the event such savings cannot be realized, the
33 commissioner of administration is hereby authorized and directed to reduce appropriations
34 to achieve such savings.

35 Section 1.H.  The commissioner of administration is authorized to make adjustments
36 to appropriations as are necessary to effectuate the governor's deficit plan approved by the
37 Joint Legislative Committee on the Budget and as provided in this Act, after review of the
38 adjustments by the Legislative Fiscal Office.

1 Section 2.A.  The Legislative Budgetary Control Council is hereby authorized and
2 directed to reduce the State General Fund (Direct) appropriation contained in Act No. 77 of
3 the 2016 Regular Session of Legislature for the Louisiana Legislature in the amount of One
4 Million Six Hundred Fifty Thousand Four Hundred Thirty-Eight and No/100 Dollars
5 ($1,650,438.00).
6 Section 2.B.  The Legislative Budgetary Control Council is hereby authorized and
7 directed to reduce the State General Fund (Direct) appropriation contained in Act No. 77 of
8 the 2016 Regular Session of the Legislature for the Louisiana Legislature in the amount of
9 One Million Eight Hundred Ninety-Four Thousand One Hundred Thirty-Six and No/100
10 Dollars ($1,894,136.00).
11 Section 2.C.  The appropriation for the legislative auditor contained in Section 3 of
12 Act No. 77 of the 2016 Regular Session of the Legislature is hereby amended and reenacted
13 to read as follows:
14 On page 5, between lines 28 and 29, insert the following:
15	"(F)  Notwithstanding any provision of this Section to the contrary, the legislative
16 auditor shall remit $2,000,000 from the Legislative Auditor Ancillary Enterprise
17 Fund to the state treasurer for deposit into the state general fund."
18 Section 3.  Notwithstanding any provision of law to the contrary, the state treasurer
19 is hereby authorized and directed to transfer to the State General Fund (Direct) the amounts
20 of any reduction in State General Fund by Fees and Self-generated Revenues, Statutory
21 Dedications, or Interagency Transfers reduced as provided or recognized in this Act,
22 excluding any reductions contained in Section 1.F., and the amounts of any reductions in
23 State General Fund by Fees and Self-generated Revenues or Statutory Dedications approved
24 and certified by the Joint Legislative Committee on the Budget.  The state treasurer shall
25 make such transfers from each fund prior to fully funding the appropriation from the fund. 
26 Within ten days after the effective date of this Act, the state treasurer shall make all transfers
27 provided in this Act.  In the event that the amount of any reduction in State General Fund
28 by Fees and Self-generated Revenues, Statutory Dedications, or Interagency Transfers being
29 transferred to the State General Fund (Direct) are insufficient to fully fund the reduction
30 made from such fund source on that date following the effective date of this Act or on that
31 date the amount remaining in Fees and Self-generated Revenues, Statutory Dedications, or

1 Interagency Transfers is insufficient to fully fund the reductions required by this Act and the
2 appropriation remaining after the reductions in this Act, the treasurer shall notify the
3 commissioner of administration and the Joint Legislative Committee on the Budget.
4 Section 4.  This Act shall become effective upon signature by the governor or, if not
5 signed by the governor, upon expiration of the time for bills to become law without signature
6 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
7 vetoed by the governor and subsequently approved by the legislature, this Act shall become
8 effective on the day following such approval.
