CLERKS OF COURT:  Provides relative to employees of the Clerk of the Orleans Parish
Criminal District Court
1	AN ACT
2To amend and reenact R.S. 13:1381.7(A), relative to Orleans Parish Criminal District Court;
3 to provide relative to the office of Clerk of the Orleans Parish Criminal District
4 Court; to provide relative to funding; to provide for a certain number of employees;
5 and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 13:1381.7(A) is hereby amended and reenacted to read as follows: 
8 §1381.7.  Clerk of the Orleans Parish Criminal District Court
9	A.  The legislature finds that adequate funding of the office of Clerk of the
10 Criminal District Court for the parish of Orleans is necessary for the efficient
11 performance of the powers and duties required of a judicial officer of the state. 
12 Pursuant to the exercise of the police power of the state, actions for obtaining
13 adequate funding are necessary to promote judicial efficiency and to protect and
14 promote the lives, health, morals, comfort, and general welfare of people as a whole. 
15 The amounts to be appropriated and paid by the city of New Orleans for expenses,
16 including salaries and maintenance of constitutional officers, their deputies,
17 subordinates, and ninety and one-half employees shall not be reduced by the city of
18 New Orleans without the consent of the legislature.

1 Section 2.  This Act shall become effective upon signature by the governor or, if not
2signed by the governor, upon expiration of the time for bills to become law without signature
3by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
4vetoed by the governor and subsequently approved by the legislature, this Act shall become
5effective on the day following such approval.

Abstract:  Provides for a certain number of employees for the office of Clerk of the Orleans
Parish Criminal District Court.
Present law provides that the amount of money paid by the city of New Orleans to the office
of the Clerk of the Orleans Parish Criminal District Court for expenses, including the salaries
and maintenance of constitutional officers, their deputies, subordinates, and employees, must
adequately fund the office of the Clerk of the Criminal District Court for Orleans Parish.  
Present law further provides that the legislature finds funding necessary for the efficient
performance of the powers and duties required of a judicial officer of the state and prohibits
reduction of these amounts by the city without the consent of the legislature.
Proposed law retains present law but specifies the exact number of employees (90½) that the
city of New Orleans shall appropriate funding for and pay to the office of Clerk of the
Orleans Parish Criminal District Court.
Effective upon signature of governor or lapse of time for gubernatorial action
(Amends R.S. 13:1381.7(A))
