AGRICULTURE/FOREST COMR: Provides relative to the disposition of timber severance
taxes
1 AN ACT
2To enact R.S. 3:4345, relative to the disposition of timber severance taxes; to authorize use
3 of severance taxes for the maintenance and construction of roads used primarily by
4 timber, lumber, and logging companies; and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 3:4345 is hereby enacted to read as follows:
7 ยง4345. Disposition of the parishes' portion of the tax
8 The portion of the timber severance tax allocated to the governing authority
9 of the parishes of this state by Article VII, Section (4)(D) of the Constitution of
10 Louisiana may be used for road maintenance and construction of roads primarily
11 used by timber, logging, and lumber companies to harvest and transport timber.

Abstract: Allows the parish-allocated portion of the timber severance tax be used for road
maintenance and construction.
Proposed law allows the funds received by the governing authority of the parishes of this
state from the timber severance tax to be used for road maintenance and construction of
roads used primarily by timber, logging, and lumber companies to harvest and transport
timber.

Summary of Amendments Adopted by House
The Committee Amendments Proposed by House Committee on Agriculture, Forestry,
Aquaculture, and Rural Development to the original bill:
1. Remove the provision requiring the governing authority of a parish that receives
timber severance tax funds to use the funds solely for road maintenance and
construction.
2. Remove the provision requiring the governing authority of any parish that
receives timber severance taxes to exhaust the funds received on road
maintenance and construction prior to requesting liability bonds or certificates
of insurance from timber, logging, or lumber companies.
