INSURANCE/HEALTH:  Exempts Louisiana residents from the assessment of penalties for
noncompliance with the Patient Protection and Affordable Care Act
1	AN ACT
2To enact R.S. 22:1019, relative to the Patient Protection and Affordable Care Act of 2010,
3 P.L. 111-148; to provide for an exemption for Louisiana residents from the penalties
4 imposed for noncompliance with the provisions of the Patient Protection and
5 Affordable Care Act; to require state officials to request waivers from certain
6 provisions of the Patient Protection and Affordable Care Act; and to provide for
7 related matters.
8Be it enacted by the Legislature of Louisiana:
9 Section 1. R.S. 22:1019 is hereby enacted to read as follows: 
10 ยง1019.  Exemption from penalties for noncompliance
11	A.  No resident of this state shall be required to pay any cost, fee, tax, or
12 penalty for failure to obtain or maintain health insurance coverage.
13	B.  The heads of all executive branch departments and agencies shall exercise
14 all authority and discretion available to them to request waivers, deferments,
15 exemptions from, or delay the implementation of any provision or requirement of the
16 provisions of the Patient Protection and Affordable Care Act of 2010, P.L. 111-148,
17 that would impose a cost, fee, tax, penalty, or regulatory burden on individuals,
18 families, healthcare providers, health insurers, patients, recipients of healthcare
19 services, purchasers of health insurance, or makers of medical devices, products, or
20 medications.

1 Section 2.  This Act shall become effective upon signature by the governor or, if not
2signed by the governor, upon expiration of the time for bills to become law without signature
3by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
4vetoed by the governor and subsequently approved by the legislature, this Act shall become
5effective on the day following such approval.

Abstract:  Exempts residents of Louisiana from any penalty imposed under the Patient
Protection and Affordable Care Act of 2010 for failing to obtain health insurance.
Proposed law exempts Louisiana residents from the penalties imposed by the Affordable
Care Act for failing to obtain health insurance.
Proposed law further requires the heads of executive branch departments and agencies to
request waivers from the penalty provisions of the Affordable Care Act, where applicable.
Effective upon signature of governor or lapse of time for gubernatorial action.
