FIRE PROTECTION.  Requires that at least one fire suppression employee in the rank of
fire fighter or fighter/operator be assigned to and carried on each force during each shift.

1	AN ACT
2 To amend and reenact R.S. 33:1967(A), relative to fire protection; to require at least one
3 full-time fire suppression employee in the rank of firefighter or firefighter/operator
4 be assigned to and carried on each force during each shift; and to provide for related
5 matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 33:1967(A) is hereby amended and reenacted to read as follows: 
8 ยง1967. Captain of force
9	A. A member of the department holding the rank of captain shall be in charge
10 of each force in each fire company during each shift and at all times. "Force" as used
11 herein means any single piece of fire fighting or rescue apparatus. In any paid fire
12 department operated by a municipality having a population of thirteen thousand or
13 more or by any parish or fire protection district which employs eight or more full-
14 time paid fire suppression employees, excluding the fire chief and any training
15 officer, every fire fighting or rescue apparatus each force shall be operated by a
16 member of the department holding the rank of engineer or fire driver, by whichever
17 designation he may be known, provided the . Each force shall also be manned by

1 at least one additional full time paid fire suppression employee holding the rank
2 of firefighter or firefighter/operator who shall be assigned to and carried on
3 each force during each shift. As provided herein, the term "fire fighting
4 apparatus" shall not be construed to include standard passenger vehicles, nor any
5 other type of automotive equipment assigned to fire department use other than
6 vehicles specially designed for fire fighting or rescue purposes. Provided further, that
7 all fire departments, regardless of the number of employees in their employ, now
8 having engineers, captains, or fire drivers operating each force, fire car, or other fire
9 vehicle shall continue this practice.

11 Section 2.  This Act shall become effective upon signature by the governor or, if not
12 signed by the governor, upon expiration of the time for bills to become law without signature
13 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
14 vetoed by the governor and subsequently approved by the legislature, this Act shall become
15 effective on the day following such approval.

Present law provides for every fire fighting or rescue apparatus to be operated by a member
of the department holding the rank of engineer or fire driver, by whichever designation he
may be known.
Proposed law retains present law and provides that each force is to be manned by at least one
additional full-time paid fire suppression employee holding the rank of firefighter or
firefighter/operator who shall be assigned to and carried on each force during each shift.
Effective upon signature of the governor or lapse of time for gubernatorial action.
