HOUSE BILL NO. 339

HEALTH SERVICES:  Provides relative to the practice of telemedicine
1	AN ACT
2To amend and reenact R.S. 37:1271.1(A)(3), relative to the practice of telemedicine; to
3 provide relative to the practice of telemedicine in licensed healthcare facilities; to
4 provide for applicability of restrictions on the practice of telemedicine; to provide
5 for regulation of the practice of medicine by the Louisiana State Board of Medical
6 Examiners; and to provide for related matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 37:1271.1(A)(3) is hereby amended and reenacted to read as follows:
9 ยง1271.1.  Practice of telemedicine in licensed healthcare facilities
10	A.  All of the following restrictions and authorizations apply to a physician
11 who holds an unrestricted license to practice medicine from the board and who
12 practices telemedicine upon any patient who is being treated at a healthcare facility
13 that is required to be licensed pursuant to the laws of this state and which holds a
14 current registration with the United States Drug Enforcement Administration:

17 prohibition or restriction on the practice of telemedicine, including prohibitions or
18 restrictions related to prescribing controlled dangerous substances, which are in any

Abstract: Provides for applicability of restrictions on the practice of telemedicine.
Present law provides that a physician who lawfully practices telemedicine in La. shall not
be subject to any regulatory prohibition or restriction on the practice of telemedicine,
including prohibitions or restrictions related to prescribing controlled dangerous substances,
which are in any manner more restrictive than the prohibitions and restrictions that are
otherwise applicable to the entire practice of medicine.
Proposed law stipulates that present law applies in all instances.
