HLS 18RS-3845 ORIGINAL 2018 Regular Session HOUSE CONCURRENT RESOL UTION NO. 85 BY REPRESENTATIVES MAGEE AND JIMMY HARRIS ALCOHOLIC BEVERAGES: Creates a task force to study issues associated with the delivery of alcoholic beverages by third party companies in this state 1 A CONCURRENT RESOL UTION 2To create and provide for the Louisiana Alcohol Delivery Task Force to study the potential 3 issues that could arise by allowing third party companies to deliver alcoholic 4 beverages from retailers and to recommend any regulations or legislation that the 5 task force deems necessary or appropriate. 6 WHEREAS, several legislative instruments were introduced in the 2018 Regular 7Session of the Legislature to authorize the delivery of alcoholic beverages by third parties; 8and 9 WHEREAS, the delivery of alcoholic beverages could impact public health and 10safety and provide additional access to underage people of our state; and 11 WHEREAS, the sale of alcoholic beverages is regulated by the Louisiana Office of 12Alcohol and Tobacco Control (hereinafter "ATC"), and the permitting of industry members 13by ATC is designed to provide regulators the platform to enforce the applicable rules and 14laws in order to provide for a safe marketplace; and 15 WHEREAS, it is urgent that the state consider the issues other states are experiencing 16with alcoholic beverage delivery prior to allowing third party delivery companies to deliver 17alcoholic beverages without a permit and, thus, no means of enforcement. 18 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby 19create the Louisiana Alcohol Delivery Task Force to study the issues that could arise if 20regulations and laws allow for delivery of alcoholic beverages by third party companies, and 21to recommend any action or legislation that the task force deems necessary and appropriate. Page 1 of 2 HLS 18RS-3845 ORIGINAL HCR NO. 85 1 BE IT FURTHER RESOLVED that the task force created herein shall consist of the 2following eleven members: 3 (1) The commissioner of alcohol and tobacco control, or her designee, who shall 4serve as the chairperson of the task force. 5 (2) The speaker of the House of Representatives or his designee. 6 (3) The president of the Senate or his designee. 7 (4) The chair of the Senate Committee on Judiciary B or another member of the 8committee designated by the chair. 9 (5) The chair of the House Judiciary Committee or another member of the committee 10designated by the chair. 11 (6) The executive director of the Louisiana Sheriffs' Association or his designee. 12 (7) The executive director of the Louisiana Oil Marketers and Convenience Store 13Association or her designee. 14 (8) The executive director of the Beer Industry League of Louisiana Inc. or his 15designee. 16 (9) The executive director of the Wine and Spirits Foundation of Louisiana or his 17designee. 18 (10) The president of the Louisiana Restaurant Association or his designee. 19 (11) The president of the Louisiana Retailers Association or his designee.
