SHERIFFS.  Allows the sheriff's offices of certain parishes to issue warning citations.

1	AN ACT
2 To amend and reenact R.S. 32:398.1(C), relative to traffic citations; to provide for warning
3 citations; to allow warning citations in Acadia, Jefferson, Lafayette, Lafourche, St.
4 Charles, St. John the Baptist, and Vermilion parishes; and to provide for related
5 matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 32:398.1(C) is hereby amended and reenacted to read as follows:
8 ยง398.1. Traffic citations; form; issuance

10	C. The Except for the sheriff's offices of Acadia, Jefferson, Lafayette,
11 Lafourche, St. Charles, St. John the Baptist, and Vermilion parishes, the
12 issuance of warning citations for violations of the motor vehicle laws of this state is
13 hereby specifically prohibited. However, nothing herein shall prohibit a peace officer
14 from issuing a violation ticket which compels or instructs the motorist to comply
15 with administrative or other legal requirements of Title 32 or Title 47 of the
16 Louisiana Revised Statutes of 1950.

Present law prohibits the issuance of warning citations for violations of motor vehicle laws.
Proposed law exempts the sheriff's offices of Acadia, Jefferson, Lafayette, Lafourche, St.
Charles, St. John the Baptist, and Vermilion parishes and allows the issuance of warning
citations in those parishes.
Present law allows peace officers in all parishes to issue a violation ticket that compels or
instructs the motorist to comply with administrative or other legal requirements.
Proposed law retains present law.
Effective August 1, 2018.
