SENATE BILL NO. 310

EDUCATION DEPARTMENT.  Provides relative to the collection and reporting of certain
data regarding students with exceptionalities. (gov sig)
1	AN ACT
2 To enact R.S. 17:3911(B)(4)(f), relative to the collection and reporting of certain data
3 relative to students with an exceptionality; to provide relative to the failure of the
4 Department of Education to comply with certain data collection and reporting
5 requirements; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 17:3911(B)(4)(f) is hereby enacted to read as follows: 
8 ยง3911. Data collection system; establishment

10	B.(1) The data collection system shall provide for but shall not be limited to
11 the regular collection of the following information on a per school basis, including
12 schools and educational programs located within secure care facilities under the
13 jurisdiction of the Department of Public Safety and Corrections, office of juvenile
14 justice:

1	(f) The commissioner of administration shall withhold one hundred
2 thousand dollars of the funds appropriated to the state Department of
3 Education through the general appropriation bill for "STATE ACTIVITIES"
4 for any fiscal year in which the department fails to collect and report the data
5 in the required manner, until such time as the department complies with the
6 provisions of this Paragraph.

8 Section 2.  This Act shall become effective upon signature by the governor or, if not
9 signed by the governor, upon expiration of the time for bills to become law without signature
10 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
11 vetoed by the governor and subsequently approved by the legislature, this Act shall become
12 effective on the day following such approval.

Present law requires the state Department of Education (DOE) to establish a standardized
data collection and analysis system to collect data from schools and school systems in a
range of specified data elements.
Present law additionally requires the annual collection and reporting of specified data
elements with respect to students with exceptionalities, excluding gifted and talented.
Further requires that the data collected be reported for each disability classification in total
and by race, gender, age, and sex.
Present law requires DOE to annually compile a report that includes the data on each
element gathered from the latest collection cycle and trend data from the three prior years.
Provides that the report be sent to each public school governing authority and published on
the department's website.
Proposed law retains present law.
Proposed law directs the commissioner of administration to withhold $100,000 of the funds
appropriated to the state DOE through the general appropriation bill for "STATE
ACTIVITIES" for any fiscal year in which the department fails to collect and report the data
in the required manner, until such time as the department complies with present law.
Effective upon signature of the governor or lapse of time for gubernatorial action.
