SENATE BILL NO. 375

SANITARY CODE.  Requires retail food establishments to maintain and promote
community hygiene as part of standardized business practices.  (8/1/18)
1	AN ACT
2 To enact R.S. 40:4.17, relative to retail food establishments; to provide for requirements of
3 retail food establishments that sell only prepackaged food items; to provide relative
4 to the Sanitary Code; to provide for terms and conditions; and to provide for related
5 matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 40:4.17 is hereby enacted to read as follows: 
8 ยง4.17.  Inspections of Retail Food Establishments
9	A. Retail food establishments that sell only prepackaged food items shall
10 maintain and promote community hygiene as part of their standardized
11 business practices.
12	B. The owner or a designated employee of each retail food establishment
13 that sells only prepackaged food items shall hold a food safety certificate
14 pursuant to the provisions of R.S. 40:5.5.
15	C. The Department of Health may approve training programs
16 specifically tailored to establishments that sell only prepackaged food items and
17 shall provide instruction and education regarding the requirements and

1 enforcement of the provisions of this Section.
2	D. The provisions of this Section may be cited as the "Good Corporate
3 Citizenship Law".

Present law provides for a state sanitary code. 
Proposed law requires retail food establishments that sell only prepackaged food items
maintain and promote community hygiene as part of their standardized business practices.
Proposed law requires the owner of a retail food establishment that sells only prepackaged
food items or his designee to obtain a food safety certificate.
Proposed law provides that the Department of Health may approve training programs for
retail food establishments that sell only prepackaged food items and shall instruct and
educate the owner or his designee of the requirements and enforcement provisions of
proposed law.
Effective August 1, 2018.
