FUNDS/FUNDING: Limits monies deposited into the Transportation Trust Fund from
being used to pay for certain Dept. of Transportation and Development expenses
1 AN ACT
2To enact R.S. 48:78(D), relative to the Transportation Trust Fund; to provide for limited use
3 of monies in the trust fund; to limit the Department of Transportation and
4 Development from using such monies in the trust fund for certain expenses; to
5 provide for an effective date; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 48:78(D) is hereby enacted to read as follows:
8 ยง78. Transportation Trust Fund; limitations on appropriations; limitations on
9 utilization

11 D.(1) Beginning in Fiscal Year 2020-2021, and each fiscal year thereafter,
12 the Department of Transportation and Development shall not use monies deposited
13 in the Transportation Trust Fund for the payment of benefits for retired employees
14 unless authorized in a general appropriation bill.
15 (2) Beginning in Fiscal Year 2021-2022, and each fiscal year thereafter, the
16 Department of Transportation and Development shall not use monies deposited in
17 the Transportation Trust Fund for the payment of benefits for current employees
18 unless authorized in a general appropriation bill.

1 (3) Beginning in Fiscal Year 2022-2023, and each fiscal year thereafter, the
2 Department of Transportation and Development shall not use monies deposited in
3 the Transportation Trust Fund for the payment of more than fifty percent of the
4 annual salary costs for current employees unless authorized in a general
5 appropriation bill.
6 (4) Beginning in Fiscal Year 2023-2024, and each fiscal year thereafter, the
7 Department of Transportation and Development shall not use monies deposited in
8 the Transportation Trust Fund for the payment of the annual salary costs for current
9 employees unless authorized in a general appropriation bill.
10 Section 2. The provisions of this Act shall become effective on July 1, 2019.

Abstract: Beginning in Fiscal Year 2021, limits Transportation Trust Fund monies from
being used to fund Dept. of Transportation and Development (DOTD) employees'
and retirees' salaries and benefits.
Present constitution requires monies deposited in the Transportation Trust Fund (TTF) to be
appropriated or dedicated solely and exclusively for costs associated with construction and
maintenance of roads and bridges of the state and federal highway systems, the Statewide
Flood-Control Program, ports, airports, transit, and the Parish Transportation Fund.
Proposed law retains present constitution but beginning in FY 2020-2021, unless authorized
in a general appropriation bill, prohibits DOTD from using monies deposited into the TTF
to pay for expenses related to retired and current employees as follows:
(1)For FY 2020-2021, and each fiscal year thereafter, DOTD shall not use TTF monies
to pay for the benefits of retired employees.
(2)For FY 2021-2022, and each fiscal year thereafter, DOTD shall not use TTF monies
to pay for the benefits of current employees.
(3)For FY 2022-2023, and each fiscal year thereafter, DOTD shall not use TTF monies
to pay for more than 50% of the annual salary costs for current employees.
(4)For FY 2023-2024, and each fiscal year thereafter, DOTD shall not use TTF monies
to pay for the annual salary costs for current employees.

Summary of Amendments Adopted by House
The Committee Amendments Proposed by House Committee on Appropriations to the
original bill:
1. Delay implementation of each phase of the limitation placed on the Dept. of
Transportation and Development's use of the monies deposited into the TTF by
one fiscal year.
2. Require authorization in a general appropriation bill for the DOTD to use monies
in the TTF for employees' and retirees' salaries and benefits.
