1	AN ACT
2 To amend and reenact R.S. 15:824(B)(1)(a), relative to the confinement of inmates; to
3 provide relative to persons committed to the custody of the Department of Public
4 Safety and Corrections who are confined in a parish jail or institution; to increase the
5 amount the Department of Public Safety and Corrections pays for the confinement
6 of persons in parish jails or institutions; to provide for required programming; and
7 to provide for related matters.
8 Be it enacted by the Legislature of Louisiana:
9 Section 1.  R.S. 15:824(B)(1)(a) is hereby amended and reenacted to read as follows: 
10 ยง824.  Commitment of persons to the Department of Public Safety and Corrections

12	B.(1)(a)  In the event any individual has been committed to the department
13 for confinement which is or has been delayed or prevented after final sentence by
14 court order restricting the department from institutionalizing the individual, or when
15 the individual is not institutionalized in a state penal or corrections institution
16 because of lack of facilities under the control of the department, or the department
17 otherwise refused to accept the individual for confinement, which resulted or has
18 resulted in the individual being confined in a parish jail or institution after final
19 sentence, or when he is being held in the parish jail without bail, pending an appeal,
20 or when he is a participant in a Blue Walters Substance Abuse Program by order of
21 a court in lieu of revocation of probation or by the board or committee on parole in
22 lieu of revocation of parole, the department shall pay to each parish sheriff, or to the
23 governing authority of those parishes in which the governing authority operates the

1 parish jail, for keeping and feeding the individual in the parish jail the sum of
2 twenty-four twenty-five dollars and thirty-nine cents per day for Fiscal Year 2019-
3 2020, the sum of twenty-six dollars and thirty-nine cents per day for Fiscal Year
4 2020-2021, and each fiscal year thereafter.  Such daily sum shall be paid from date
5 of sentencing until the individual is confined in a penal or correctional institution
6 under the supervision of the department.  The department shall work with sheriffs,
7 or the governing authority of those parishes in which the governing authority
8 operates the parish jail, to ensure that the basic jail guidelines are amended by
9 December 31, 2020, to specifically provide for treatment and educational
10 programming for individuals confined in a parish jail or institution.
