ALCOHOLIC BEVERAGES.  Provides relative to the definition of liquor retail distribution

1	AN ACT
2 To amend and reenact R.S. 26:2(9), relative to Alcoholic Beverage Control Law; to provide
3 relative to the definition of liquor retail distribution center; to provide for an effective
4 date; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 26:2(9) is hereby amended and reenacted to read as follows:
7 ยง2. Definitions
8	For purposes of this Chapter, the following terms have the respective
9 meanings ascribed to them in this Section, unless a different meaning clearly appears
10 from the context:

12	(9) "Liquor retail distribution center" means any commercial airline that
13 stores alcoholic beverages in sealed containers of any size at any airport regularly
14 served by the permittee. Such possession for retail sale or distribution therefrom shall
15 be limited to alcohol of high volume content in any quantity. Effective until
16 July 1, 2021, the term "liquor retail distribution center" shall include any liquor
17 retailer who has continuously maintained a distribution center or centers for

1 distribution to its wholly owned retail permittees on or prior to January 1, 1961,
2 in this state.

4 Section 2.  This Act shall become effective upon signature by the governor or, if not
5 signed by the governor, upon expiration of the time for bills to become law without signature
6 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
7 vetoed by the governor and subsequently approved by the legislature, this Act shall become
8 effective on the day following such approval.

Present law, regarding Alcoholic Beverage Control Law, provides a three-tier system for
distribution of alcoholic beverages and mandates separation between the tiers. The first tier
consists of producers, manufacturers, and suppliers; the second tier consists of distributors
and wholesalers; and the third tier consists of retailers. With few exceptions, only retailers
(supermarkets, liquor stores, bars, restaurants, hotels, etc.) may sell to consumers.
Present law defines "liquor retail distribution center" as any commercial airline that stores
alcoholic beverages in sealed containers of any size at any airport regularly served by the
permittee. Provides that possession for retail sale or distribution therefrom shall be limited
to alcohol of high volume content in any quantity.
Proposed law retains present law and adds that effective until July 1, 2021, the definition
shall include any liquor retailer who has continuously maintained a distribution center or
centers for distribution to its wholly owned retail permittees on or prior to January 1, 1961,
in Louisiana. Proposed law restores language deleted by Act No. 449 of the 2018 Regular
Session.
Effective upon signature of the governor or lapse of time for gubernatorial action.
