SENATE BILL NO. 194

EDUCATION DEPARTMENT.  Provides for development of a statewide framework for
dual enrollment. (8/1/19)
1	AN ACT
2 To amend and reenact R.S. 17:183.3(A)(1)(b) and 3163(A) and (B)(5), to enact R.S.
3 17:2922.1 and 2922.2, and to repeal Subpart A-3 of Part III of Chapter 1 of Title 17
4 of the Louisiana Revised Statutes of 1950, comprised of R.S. 17:187.1 through
5 187.5, R.S. 17:2929, 3129.1, 3129.8, 3137, 3138.1, and Chapter 41 of Title 17 of the
6 Louisiana Revised Statutes of 1950, comprised of 17:3951, relative to dual
7 enrollment; to provide for the development and implementation of a statewide
8 framework for dual enrollment; to provide for criteria for dual enrollment courses
9 and student eligibility to enroll in the courses; to provide for a course price structure;
10 to provide for data collection and reporting; to provide with respect of the College
11 and Career Readiness Commission; and to provide for related matters.
12 Be it enacted by the Legislature of Louisiana:
13 Section 1.  R.S. 17:183.3(A)(1)(b) and 3163(A) and (B)(5) are hereby amended and
14 reenacted, and R.S. 17:2922.1 and 2922.2 are hereby enacted to read as follows: 
15 §183.3. Career major; description; curriculum and graduation requirements
16	A.(1)(a) *          *          *
17	(b) Students pursuing a career major shall be afforded the opportunity to

1 dually enroll in an a Louisiana public postsecondary institution under the
2 management and supervision of the Board of Supervisors of Community and
3 Technical Colleges or participate in a business internship or work-study program
4 when such opportunities are available and appropriate.

6 §2922.1. College and Career Readiness Commission; creation; purpose; duties
7	and responsibilities; membership; vacancies; compensation;
8	reporting
9	A. The College and Career Readiness Commission is hereby created for
10 the purpose of making recommendations for the development of statewide
11 policies, guiding principles, and programs to ensure student readiness for
12 postsecondary education and the workforce.
13	B. The membership of the commission shall be as follows:
14	(1) The governor or his designee.
15	(2) The state superintendent of education or his designee.
16	(3) Four members of the State Board of Elementary and Secondary
17 Education, appointed by the president of the board.
18	(4) The commissioner of higher education or his designee.
19	(5) The chairman of the Board of Regents or his designee.
20	(6) The chairman of the House Committee on Education or his designee.
21	(7) The chairman of the Senate Committee on Education or his designee.
22	(8) The president of the Louisiana Community and Technical College
23 System or his designee.
24	(9) The president of the University of Louisiana System or his designee.
25	(10) The deputy secretary of the office of juvenile justice or his designee.
26	(11) The secretary of the Louisiana Workforce Commission or his
27 designee.
28	(12) The chairman of the Louisiana Workforce Investment Council or
29 his designee.

1	(13) An adult with a disability or a parent of a child with a disability,
2 appointed by the state superintendent of education.
3	(14) The current Louisiana High School Teacher of the Year.
4	(15) The current Louisiana High School Principal of the Year.
5	(16) A representative of the Louisiana Association of Educators.
6	(17) A representative of the Louisiana Federation of Teachers.
7	(18) A representative of the Associated Professional Educators of
8 Louisiana.
9	(19) A representative of the Louisiana School Boards Association.
10	(20) A representative of the Louisiana Association of School
11 Superintendents.
12	(21) A representative of the Louisiana Association of Principals.
13	(22) A representative of the Louisiana Association of Special Education
14 Administrators.
15	(23) A representative of the Louisiana Parent-Teacher Association.
16	(24) A representative of the Louisiana Association of School Executives.
17	(25) Two representatives from business, civic, labor, or community
18 organizations, to be appointed by the governor.
19	(26) A current high school senior, to be appointed by the governor.
20	(27) A dean of a college of education of a Louisiana public college or
21 university, to be appointed by the commissioner of higher education.
22	(28) A representative of the Louisiana Nonpublic School Commission
23 selected by the Louisiana Nonpublic School Commission.
24	C.(1) Members of the commission shall serve at the pleasure of the
25 appointing authority. Vacancies shall be filled in the manner of the original
26 appointment.
27	(2) A member shall be removed from the commission if any of the
28 following apply:
29	(a) The member is no longer a legal resident of the state.

1	(b) The member fails to remain active in the organization he was
2 appointed to represent or is no longer employed by the agency he was appointed
3 to represent.
4	(c) The member is absent from two consecutive meetings of the
5 commission, unless such absences are excused by the chairman.
6	D.(1) All legislative members of the commission shall receive the same
7 per diem and travel allowance for attending meetings of the commission as is
8 normally provided for meetings of legislative committees, payable out of funds
9 appropriated for expenses of the legislature.
10	(2) Other members of the commission shall serve without compensation,
11 but may be reimbursed for actual expenses in accordance with state travel
12 regulations should funds become available for this purpose.
13	E. The chairman of the commission shall be appointed by the governor,
14 with the advice of the State Board of Elementary and Secondary Education and
15 the Board of Regents.
16	F. The governor shall designate staff to assist the commission in
17 performing its duties and responsibilities.
18	G. In making its recommendations, the commission shall consider the
19 following:
20	(1) Strategies for increasing dual enrollment opportunities for high
21 school students, including an emphasis on the following:
22	(a) Early entry into postsecondary education institutions.
23	(b) The identification of funding sources for dual enrollment
24 opportunities.
25	(c) Improved articulation agreements between secondary schools and
26 postsecondary education institutions.
27	(2) Strategies for:
28	(a) Strengthening the value of the state's high school diploma
29 endorsements.

1	(b) Defining the levels of knowledge and skills necessary for students who
2 are enrolling in courses for credit at postsecondary education institutions and
3 encouraging secondary schools and postsecondary education systems to align
4 their standards and assessments with such knowledge and skill levels.
5	(c) Better integration of the WorkKeys job skill assessment system into
6 high school preparation programs and initiatives.
7	(d) Increasing the rigor of the high school curriculum, including an
8 emphasis on establishing a default core curriculum and exploring the concept
9 of testing students at the end of each course that the student completes.
10	(e) Reducing the number of high school dropouts in the state, including
11 strategies and opportunities for students who have fallen behind academically
12 to make the progress necessary in order to be eligible to graduate from high
13 school.
14	(f) Improving the high school senior year in order for the year to be a
15 meaningful and academically enriched time in preparing such students for
16 graduation and life beyond high school.
17	(3) Any other strategies or initiatives that the commission deems
18 important and necessary in carrying out its duties and responsibilities.
19	H. The commission shall annually submit a written report of its findings
20 and recommendations to the governor, the State Board of Elementary and
21 Secondary Education, and the Board of Regents not later than January thirty-
22 first.
23 §2922.2. Statewide dual enrollment framework
24	A.(1) The Board of Regents and the State Board of Elementary and
25 Secondary Education shall jointly develop a statewide dual enrollment
26 framework to maximize the participation in and utilization of dual enrollment
27 courses among the state's public high school students.
28	(2) The recommendations of the College and Career Readiness
29 Commission shall be considered in developing and implementing the dual

1 enrollment framework.
2	B. "Dual enrollment" means the enrollment of a high school student in
3 a college course for which both college and high school credit may be earned.
4	C. Dual enrollment courses may include:
5	(1) Academic courses leading to credit that will transfer to public
6 postsecondary institutions and which apply toward an academic undergraduate
7 degree program.
8	(2) Career and technical education courses aligned with the career major
9 option as provided in R.S. 17:183.1 et seq. and which are applicable to a public
10 postsecondary credential.
11	D. The dual enrollment framework shall:
12	(1) Coordinate dual enrollment efforts of the Board of Regents, the State
13 Board of Elementary and Secondary Education, the Louisiana Department of
14 Education, the public postsecondary education management boards and
15 institutions, and the governing authority of each public high school.
16	(2) Guarantee statewide articulation of approved dual enrollment
17 courses between high schools and public postsecondary education institutions.
18	(3) Ensure each dual enrollment course is treated the same by a public
19 postsecondary education institution as the equivalent college course which is not
20 provided for dual enrollment.
21	(4) Require that dual enrollment courses and grades are recorded on a
22 student's permanent academic transcript of both the postsecondary education
23 institution offering the course and the student's high school.
24	(5) Provide a dual enrollment course crosswalk between the equivalent
25 high school and postsecondary courses and delineates which college courses
26 offered meet the high school graduation requirements.
27	E. The Board of Regents, with input from each public postsecondary
28 education management board and the state Department of Education, shall:
29	(1) Establish minimum requirements for public postsecondary

1 institutions that offer dual enrollment courses, including:
2	(a) Student eligibility.
3	(b) Course content and rigor requirements.
4	(c) Dual enrollment instructor training and oversight.
5	(d) Compliance monitoring.
6	(2) Develop a dual enrollment website to provide information to students,
7 parents or legal guardians, high school teachers, guidance counselors, and
8 administrators, which shall include:
9	(a) A common application.
10	(b) The list of available dual enrollment courses.
11	(c) The dual enrollment course crosswalk.
12	(d) Dual enrollment course eligibility requirements.
13	(d) A link to each postsecondary institutions' dual enrollment website.
14	(e) Evaluate the effectiveness of the dual enrollment program and make
15 necessary changes.
16	(4) Establish a uniform pricing structure and maximum tuition for dual
17 enrollment courses offered by each public postsecondary education institution
18 which differentiates whether courses are taught on campus, online, at a high
19 school by a faculty member or instructor employed by the postsecondary
20 education institution, or at a high school by a qualified high school instructor.
21	(5) Administer funds appropriated or otherwise allocated for statewide
22 coordination, initiatives for equitable course availability or programs,
23 instructor support, and research and evaluation.
24	F. The State Board of Elementary and Secondary Education shall
25 require the state Department of Education to:
26	(1) Assist the governing authority of each public high school to identify
27 state and federal funds, in addition to local funds allocated for the purpose of
28 supplementing course instruction, which may be used to support student
29 participation in dual enrollment courses.

1	(2) Recognize and reward schools that graduate students who have
2 earned significant credit toward a postsecondary credential or degree.
3	(3) Develop and maintain the dual enrollment course crosswalk.
4	(4) Collaborate with the Board of Regents staff to fulfill the requirements
5 pursuant to this Section.
6	G. The governing authority of each public high school shall:
7	(1) Notify each student of dual enrollment opportunities and eligibility
8 requirements and assist each student in identifying and enrolling in the courses.
9	(2) Collaborate with public postsecondary institutions to facilitate dual
10 enrollment course offerings, planning, registration, and student support.
11	(3) Provide remediation and guidance to each high school sophomore
12 who has been identified as not being on track to be eligible for dual enrollment
13 courses to improve his academic preparation.
14	(4) Offer at least two dual enrollment courses per year at no cost to each
15 eligible high school junior and senior. These courses shall be aligned to the
16 career major program prescribed in R.S. 17:183.1 et seq. and be applicable to
17 a postsecondary credential.
18	H. Each public postsecondary education institution shall:
19	(1) Collaborate with local public high schools to facilitate dual
20 enrollment course offerings, planning, registration, and student support.
21	(2) Ensure compliance with the Board of Regents' minimum
22 requirements provided for in Subsection D of this Section.
23	(3) Provide dual enrollment course information on its website.
24	I.(1) The Board of Regents shall submit a written report to the Senate
25 and House committees on education, not later than September thirtieth of each
26 year, on the status of dual enrollment in Louisiana. The report shall include the
27 following:
28	(a) The number of high school students enrolled in dual enrollment
29 courses in the current and preceding year.

1	(b) The number of high school students who passed a dual enrollment
2 course during the prior academic year, including data by student classification
3 and other student characteristics as required by the Board of Regents.
4	(c) The number of postsecondary credits earned through dual enrollment
5 courses during the prior academic year, including data by postsecondary course
6 and other information as required by the Board of Regents.
7	(d) Recommendations for legislation.
8	(2) The state Department of Education shall assist the Board of Regents
9 in collecting data and preparing the report required by this Subsection.

11 §3163. Statewide Articulation and Transfer Agreement
12	A. The Board of Regents and the State Board of Elementary and Secondary
13 Education shall coordinate enter into a statewide articulation agreement that shall
14 to govern the articulation and transfer of credit between and among the state's public
15 secondary and postsecondary educational institutions.

17	B. The statewide articulation agreement shall, at a minimum:
18	*          *          *
19	(5) Guarantee the statewide articulation of appropriate career and technical
20 education programs and workforce development programs and transfer of course
21 credits between secondary schools and technical and community colleges.

23 Section 2.  Subpart A-3 of Part III of Chapter 1 of Title 17 of the Louisiana Revised
24 Statutes of 1950, comprised of R.S. 17:187.1 through 187.5, R.S. 17:2929, 3129.1, 3129.8,
25 3137, 3138.1, and Chapter 41 of Title 17 of the Louisiana Revised Statutes of 1950,
26 comprised of R.S. 17:3951, are hereby repealed.
27 Section 3.  This Act shall become effective on August 1, 2019; if vetoed by the
28 governor and subsequently approved by the legislature, this Act shall become effective on
29 August 1, 2019, or on the day following such approval by the legislature, whichever is later.
