2019 Regular Session ENROLLED SENATE CONCURRENT RESOL UTION NO. 123 BY SENATOR MARTINY A CONCURRENT RESOL UTION To establish the Task Force on Cyber Incident and Response to develop a tabletop exercise in which the state and private entities can test and strengthen the existing infrastructure to combat cyber threats and attacks and improve ongoing communication procedures. WHEREAS, cybersecurity threats are constant and criminals consistently target computer networks, thereby increasing the number and exigent danger of cybersecurity breaches; and WHEREAS, many of today's activities are increasingly dependent on information systems, electronic devices, and data networks; and WHEREAS, vulnerabilities constantly emerge, and as a result, security risks are increasing in number, frequency, and impact; and WHEREAS, other states have recently experienced attacks that resulted in energy outages and network shutdowns of state agencies; and WHEREAS, Louisiana must be prepared to respond to cybersecurity threats, in part, by developing a partnership between private entities and public bodies; and WHEREAS, the proposed tabletop exercise will consist of a simulated incident that requires a partnership between the participating state agencies and private partners to address and neutralize the cyber threat, as well as minimize any damage to private citizens, businesses, and state infrastructure; and WHEREAS, the members of the Legislature of Louisiana believe that a tabletop exercise that focuses on strengthening a critical infrastructure response to cyber attacks will benefit both private entities and the state in the ongoing battle against cybercrime; and WHEREAS, with the current budget deficit, the funding necessary to plan and Page 1 of 4 SCR NO. 123 ENROLLED conduct this exercise will require innovation and advance planning on behalf of the task force. THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby create the Task Force on Cyber Incident and Response to strengthen its existing infrastructure and defense. BE IT FURTHER RESOLVED that the task force shall be comprised of the following nineteen members: (1) The chairman of the House Committee on Commerce or his designee. (2) The chairman of the Senate Committee on Commerce, Consumer Protection, and International Affairs or his designee. (3) The executive director of the Stephenson Disaster Management Institute - Louisiana State University or his designee. (4) The executive director of the Louisiana Business Emergency Operations Center or his designee. (5) The executive director of the Governor's Office of Homeland Security or his designee. (6) The executive director of the Cyber Innovation Center or his designee. (7) The director of business intelligence at Louisiana Economic Development or his designee. (8) The president of the Louisiana Association of Business and Industry or his designee. (9) The Louisiana attorney general or his designee. (10) The chairman of the Louisiana Chemical Association or his designee. (11) The chairman of the Louisiana Mid-Continent Oil and Gas Association or his designee. (12) The president of the Baton Rouge Area Chamber or his designee. (13) The director of the Louisiana State Analytical Fusion Exchange or his designee. (14) The special agent in charge of the New Orleans field office of the Federal Bureau of Investigation or his designee. (15) The superintendent of Louisiana State Police or his designee. Page 2 of 4 SCR NO. 123 ENROLLED (16) The adjutant general of the Louisiana Army National Guard or his designee. (17) The executive secretary of the Public Service Commission or his designee. (18) The chief executive officer of the LTCA-The Internet and Television Association or his designee. (19) The president of the Louisiana Telecommunications Association or his designee. BE IT FURTHER RESOLVED that the executive director of the Cyber Innovation Center and the executive director of the Louisiana Business Emergency Operations Center shall be jointly responsible for designating, delegating, and managing the duties of the task force, and shall convene its first meeting no later than October 1, 2019, at which time the task force shall adopt rules of procedure, a work and planning schedule, and develop any additional measures that it deems necessary for the timely performance of its duties, including selection of officers. BE IT FURTHER RESOLVED that the members of this task force shall serve without compensation, except per diem or expense reimbursement to which they may be individually entitled to as members of the constituent organizations. BE IT FURTHER RESOLVED that the task force shall submit a written report of its findings and recommendations, along with a fiscal plan for the exercise, to the House Committee on Commerce and the Senate Committee on Commerce, Consumer Protection, and International Affairs no later than February 1, 2020. BE IT FURTHER RESOLVED that the report shall include a proposed budget for the exercise, the source of funding for the exercise, a date for the exercise, a list of proposed participants, and a location for the exercise. BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the Stephenson Disaster Management Institute - Louisiana State University, the Louisiana Business Emergency Operations Center, the Governor's Office of Homeland Security, the Cyber Innovation Center, Louisiana Economic Development, the Louisiana Association of Business and Industry, the Louisiana Attorney General, the Louisiana Chemical Association, the Louisiana Mid-Continent Oil and Gas Association, the Baton Rouge Area Chamber, the Louisiana State Analytical Fusion Exchange, the New Orleans Field Office of the Federal Bureau of Investigation, Louisiana State Police, the Louisiana Army National Guard, the Page 3 of 4 SCR NO. 123 ENROLLED Public Service Commission, the LCTA - The Internet and Television Association, and the Louisiana Telecommunications Association.
