LEGISLATIVE PROCEDURE: (Constitutional Amendment) Provides for laws relative to
statutory dedications
1 A JOINT RESOLUTION
2Proposing to add Article VII, Section 9.1 of the Constitution of Louisiana, to create a
3 protected special fund which requires the enactment of a law by two-thirds of the
4 elected members of each house of the legislature to increase or decrease the amount
5 of monies dedicated to the fund, to modify the purposes for which monies in the fund
6 may be used, or to repeal the fund; to provide for submission of the proposed
7 amendment to the electors; and to provide for related matters.
8 Section 1. Be it resolved by the Legislature of Louisiana, two-thirds of the members
9elected to each house concurring, that there shall be submitted to the electors of the state of
10Louisiana, for their approval or rejection in the manner provided by law, a proposal to add
11Article VII, Section 9.1 of the Constitution of Louisiana, to read as follows:
12 §9.1. Protected special funds
13 Section 9.1. Any fund designated as a fund shall require the enactment of a
14 law by two-thirds of the elected members of each house of the legislature:
15 (1) Creation of a protected special fund in the state treasury.
16 (2) Increasing or decreasing the amount of monies dedicated to a protected
17 fund in the state treasury.
18 (3) Modifying the purposes for which monies in a protected special fund in
19 the state treasury may be used or requirements for using monies.
20 (4) Repeal of a protected special fund.

1 Section 2. Be it further resolved that this proposed amendment shall be submitted
2to the electors of the state of Louisiana at the statewide election to be held on November 3,
32020.
4 Section 3. Be it further resolved that on the official ballot to be used at the election,
5there shall be printed a proposition, upon which the electors of the state shall be permitted
6to vote YES or NO, to amend the Constitution of Louisiana, which proposition shall read as
7follows:
8 Do you support an amendment to create a protected special fund which
9 requires the enactment of a law by two-thirds of the elected members of each
10 house of the legislature to increase or decrease the amount of monies
11 dedicated to the special fund, or to modify the purposes for which monies in
12 a special fund may be used, or to repeal the fund? (Adds Article VII, Section
13 9.1)
