This Act shall become effective upon signature by the governor or, if not 7signed by the governor, upon expiration of the time for bills to become law without signature 8by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 9vetoed by the governor and subsequently approved by the legislature, this Act shall become 10effective on the day following such approval. Present law authorizes the governor to declare a state of public health emergency. Present law provides that during a state of public health emergency, the following classes of persons shall not be civilly liable for causing the death of, or injury to, any person or damage to any property except in the event of gross negligence or willful misconduct: (1)Healthcare providers. (2)Private persons, firms, or corporations and employees and agents of such persons, firms, or corporations, who render assistance or advice at the request of the state or its political subdivisions pursuant to the La. Health Emergency Powers Act. Proposed law retains present law but makes it effective only during a state of public health emergency declared as provided in present law. Effective upon signature of governor or lapse of time for gubernatorial action.
