HOUSE BILL NO. 683
BY REPRESENTATIVE CREWS
WILDLIFE & FISHERIES:  Provides relative to royalties on dredged materials
1	AN ACT
2To amend and reenact R.S. 56:2011(D) and (E), relative to royalties on dredged materials;
3 to provide for exemptions from payment of certain royalties and bond requirements;
4 and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 56:2011(D) and (E) are hereby amended and reenacted to read as
7follows: 
8 ยง2011.  License to dredge; royalties; exemptions
9	*          *          *
10	D.  Only holders of Class A and D licenses shall be authorized to sell fill sand
11 or fill material dredged.  Holders of Class B, C, D, or E licenses shall not sell fill
12 sand or fill material which was dredged or caused to be dredged under authority of
13 those licenses.
14	E.  Any private landowner, state agency, political subdivision, or associated
15 consultant or contractor engaged in a coastal protection, conservation, or restoration
16 activity consistent with an annual plan or the comprehensive master plan established
17 pursuant to R.S. 49:214.5.3, or engaged in an activity to remove sediment buildup
18 to preserve or restore the natural habitat of a any water body of the state or to
19 enhance navigation and recreation activities on a any water body of the state shall be
20 exempt from payment of the royalties and bond requirements of this Section.

1 However, any such private landowner, state agency, political subdivision, or
2 associated consultant or contractor shall be required to apply for and receive the
3 appropriate license required by this Section.  To be eligible for exemption from the
4 royalty payment and bond requirements of this Section, a private landowner shall
5 obtain a letter of no-objection from either the governing authority of the political
6 subdivision within which the activity will occur, or the local coastal management
7 program under which the activity is authorized, and the approval, in writing, of the
8 secretary of the Department of Natural Resources, the secretary of the Department
9 of Transportation and Development, and the executive director of the Coastal
10 Protection and Restoration Authority.

Abstract:  Allows persons who hold certain licenses to sell dredged material and specifies
that the royalty and bonding exemption for dredging operations and dredged
materials applies to all waterbodies of the state.
Present law provides for Class A, B, C, D, and E classes of licenses to dredge materials from
the water bottoms of this state.
Present law further provides that only holders of Class A licenses are authorized to sell fill
sand or fill material dredged. Further, holders of Class B, C, D, or E licenses cannot sell fill
sand or fill material which was dredged or caused to be dredged under authority of those
licenses.
Proposed law allows holders of Class D permits to sell fill sand or fill material that was
dredged.
Present law provides for bond requirements for dredging activities and royalty requirements
for dredged material.
Present law grants an exemption from payment of the present law royalties and bond
requirements to any private landowner, state agency, political subdivision, or associated
consultant or contractor engaged in a coastal protection, conservation, or restoration activity
consistent with an annual plan or the comprehensive master plan, or engaged in an activity
to remove sediment buildup to preserve or restore the natural habitat of  a waterbody of the
state or to enhance navigation and recreation activities on a waterbody of the state.

Proposed law retains present law and specifies that the provisions of present law apply to all
waterbodies of the state.
