DISTRICTS/WATERSHED: Provides relative to property taxes generated for the Comite River Diversion Canal Impact Area 1 AN ACT 2To amend and reenact R.S. 38:3309, relative to taxes levied on the Comite River Diversion 3 Canal Impact Area; to provide for alternative uses of drainage taxes collected; to 4 require a proposition for authorization of alternative uses; and to provide for related 5 matters. 6Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 38:3309 is hereby amended and reenacted to read as follows: 8 ยง3309. Authority to levy 9 A. For the purpose of providing revenue to carry out the objects 10 contemplated by this Chapter, the board of commissioners may levy on all property 11 in the district, or on all property within the Comite River Diversion Canal Impact 12 Area, subject to taxation for drainage purposes, a district drainage tax. The tax shall 13 not be levied unless the proposition to levy the tax is approved by a majority of the 14 electors of the district, or by a majority of the electors of the Comite River Diversion 15 Canal Impact Area if limited to such area, who vote on the proposition. 16 B. If the board of commissioners desires to use revenue from the drainage 17 tax for the purposes of any flood risk reduction within the Comite River Diversion 18 Canal Impact Area that was not approved by the voters of the impact area on July 15, 19 2000, and October 2, 2010, the board shall submit to the voters of the impact area a 20 proposition authorizing the district to use the revenue for such purposes. Present law authorizes the Amite River Basin District board of commissioners to levy a tax on the Comite River Diversion Impact Area. Proposed law retains present law and further provides that if the board wants to use taxes collected for localized or non-localized flood risk reduction uses not approved by the voters of the impact area, the board must submit a new proposition to the same voters for approval of a new purpose.
