ENERGY/ALTERNATE:  Provides relative to fee exemptions for certain solar power
generation facilities
1	AN ACT
2To amend and reenact R.S. 30:1154(D)(3), relative to solar power generation facilities; to
3 include solar power generation facilities that have power purchase agreements in
4 place to those facilities that are exempt from certain fees; and to provide for related
5 matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 30:1154(D)(3) is hereby amended and reenacted to read as follows:
8 ยง1154.  Regulations governing solar power generation facilities; solar leases

12	(3)  Any solar power generation facility that is certified by the Public Service
13 Commission or the council of the city of New Orleans, or has a power purchase
14 agreement in place, on or before August 2, 2022, shall be exempt from the fees
15 provided for in this Section, shall register with the department by January 1, 2023,
16 and shall comply with the requirements of this Section and any rules and regulations
17 promulgated pursuant to this Section by June 30, 2024.

Abstract:  Includes solar power generation facilities that have active power purchase
agreements to those facilities that are exempt from application, processing, and
monitoring fees.
Present law specifies that any solar power generation facility that is certified by the Public
Service Commission or the council of the city of New Orleans on or before Aug. 2, 2022,
is exempt from the application, processing, and monitoring fees provided for in present law.
Proposed law retains present law and adds facilities that have power purchase agreements
in place to those exempt from the enumerated fees.
