1	AN ACT
2 To amend and reenact R.S. 40:1125.13 and to enact R.S. 17:436.5 and 3996(B)(82), relative
3 to sickle cell disease; to provide for the sickle cell disease registry; to provide for
4 individuals diagnosed with sickle cell disease; to provide for the exchange of data
5 by a healthcare provider with certain associations; to provide for sickle-cell training
6 for school nurses; and to provide for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 17:436.5 and 3996(B)(82) are hereby enacted to read as follows:
9 §436.5.  Sickle cell disease; training for school nurses
10	A.  Each local public school board shall adopt a policy to require that each
11 school nurse participates in an in-service training program of at least one hour
12 relative to sickle cell disease.  The school boards shall use the instructional materials
13 provided in accordance with Subsection C of this Section.  The training may be
14 incorporated into an existing in-service training program.
15	B.  The program shall include information on symptoms of and treatments
16 for sickle cell disease in children and shall include, at minimum, the following:
17	(1)  The medical needs students may have in a school setting related to the
18 physiological complications of the disease, including but not limited to anemia,

1 sensitivity to heat and cold, increased urinary frequency, pain episodes, fevers, and
2 stroke.
3	(2)  Possible accommodations in the classroom, at recess, and during school
4 meal times for students who experience health problems associated with sickle cell
5 disease during the school day.
6	(3)  Methods for communicating with parents and other school personnel in
7 order to support positive academic outcomes for students with sickle cell disease.
8	C. The Louisiana Sickle Cell Commission shall develop the instructional
9 materials, which shall be made available on the Louisiana State Board of Nursing's
10 website.

12 §3996.  Charter schools; exemptions; requirements

14	B.  Notwithstanding any state law, rule, or regulation to the contrary and
15 except as may be otherwise specifically provided for in an approved charter, a
16 charter school established and operated in accordance with the provisions of this
17 Chapter and its approved charter and the school's officers and employees shall be
18 exempt from all statutory mandates or other statutory requirements that are
19 applicable to public schools and to public school officers and employees except for
20 the following laws otherwise applicable to public schools with the same grades:

24 Section 2. R.S. 40:1125.13 is hereby amended and reenacted to read as follows: 
25 §1125.13.  Healthcare facilities; reporting of data
26	A.  Upon making a diagnosis of sickle cell disease, a healthcare provider
27 shall provide to the department data regarding the individual who has been diagnosed
28 with the disease.  The form and manner of the data shall be prescribed by the
29 department by rule duly promulgated in accordance with the Administrative
30 Procedure Act.

1	B. The Louisiana Department of Health shall facilitate an agreement between
2 sickle cell clinics as provided for in R.S. 40:1125.31 et seq, and an association that
3 is part of the Louisiana Sickle Cell Commission that provides information and
4 assistance to patients diagnosed with sickle cell disease. The agreement shall allow
5 for the transfer of sufficient contact information from the sickle cell clinics to allow
6 an association to contact the patient.
