HLS 24RS-2092 REENGROSSED 2024 Regular Session HOUSE BILL NO. 930 BY REPRESENTATIVES VENTRELLA, BUTLER, CREWS, EGAN, EMERSON, OWEN, AND WILDER COSMETOLOGY: Provides relative to cosmetology 1 AN ACT 2To amend and reenact R.S. 37:582 and 586(A)(1) and (2) and to enact R.S. 37:563(18) and 3 (19), 575(A)(18), and 595(B)(9), relative to cosmetology; to provide for the duties 4 of the Louisiana State Board of Cosmetology; to require the creation of a website by 5 the board; to provide for examination requirements; to provide for definitions; to 6 provide for the requirements for cosmetology schools; to outline the hours of 7 instruction needed for a hair design license; and to provide for related matters. 8Be it enacted by the Legislature of Louisiana: 9 Section 1. R.S. 37:582 and 586(A)(1) and (2) are hereby amended and reenacted and 10R.S. 37:563(18) and (19), 575(A)(18), and 595(B)(9) are hereby enacted to read as follows: 11 §563. Definitions 12 As used in this Chapter, the following words have the following meanings: 13 * * * 14 (18) "Hair design" means the practice of arranging, dressing, cutting, 15 trimming, styling, shampooing, permanent waving, chemical relaxing, straightening, 16 curling, bleaching, lightening, coloring, mustache and beard design, and superficial 17 skin stimulation of the scalp. 18 (19) "Hair designer" means a person licensed in accordance with this 19 Chapter to engage in the practice of hair design. 20 * * * Page 1 of 5 CODING: Words in struck through type are deletions from existing law; words underscored are additions. The board shall be responsible for the control and regulation of the 3 practice of cosmetology and shall do all of the following: 4 * * * 5 (18) Create and maintain a website that allows applicants to apply, pay fees, 6 and see their current status for cosmetology licensure. 7 * * * 8 §582. Qualifications for certificate as a registered cosmetologist, hair designer, 9 esthetician, or manicurist; out-of-state licensees 10 A. In order to receive a certificate of registration as a registered 11 cosmetologist, hair designer, esthetician, or manicurist, a person shall, in addition to 12 the requirements set forth in Subsection B of this Section, meet all of the following 13 requirements: 14 (1) Be at least sixteen years of age. 15 (2) Have, at the time of completion of the required schooling, the equivalent 16 training as would be contemplated in the satisfactory completion of the tenth grade 17 from an approved high school. 18 (3) Have satisfactorily passed an examination conducted by the board to 19 determine his fitness to receive a certificate of registration. 20 (4) Have paid the appropriate fee set forth in R.S. 37:599. 21 B. In addition to the requirements set forth in Subsection A of this Section, 22 a person shall also meet the following requirements in order to obtain his certificate 23 of registration as a registered cosmetologist, hair designer, esthetician, or manicurist: 24 (1) To obtain a certificate as a registered cosmetologist, a person shall have 25 completed and passed a course at a registered or licensed school of cosmetology 26 approved by the board. 27 (2) To obtain a certificate as a registered esthetician, a person shall have 28 completed and passed an esthetics course at a registered or licensed school of 29 cosmetology approved by the board. HLS 24RS-2092 REENGROSSED HB NO. 930 1 (3) To obtain a certificate as a registered manicurist, a person shall have 2 completed and passed a manicuring course at a registered or licensed school of 3 cosmetology approved by the board. 4 (4) To obtain a certificate as a registered hair designer, a person shall have 5 completed and passed a hair designing course at a registered or licensed school of 6 cosmetology approved by the board. 7 C. The board shall issue the appropriate certificate of registration to any 8 person who possesses a license or certificate of registration to practice as a 9 cosmetologist, hair designer, esthetician, or manicurist from another state or from a 10 foreign country and who also meets the following requirements: 11 (1) Has completed and passed the appropriate course of study at a school 12 which is licensed in the state or country which issued the license. 13 (2) Has satisfactorily passed the appropriate examination conducted by the 14 board national interstate council of state boards of cosmetology, or NIC, written and 15 practical examinations to determine his fitness to receive the certificate of 16 registration. 17 (3) Has paid the appropriate fee set forth in R.S. 37:599. 18 * * * 19 §586. Examination of applicants 20 A.(1) The examination team and testing service contracted by the board shall 21 conduct examinations of applicants for certificates as registered cosmetologists, hair 22 designers, estheticians, manicurists, teachers, and for any special permit issued by 23 the board which requires testing at such times and places as deemed appropriate by 24 the board. 25 (2) Practical cosmetologist, hair design, Louisiana state theory, and national 26 theory examinations shall be conducted at least twice monthly. 27 * * * 28 §595. All registered cosmetology schools may offer one or more of the 2 following courses, and postsecondary schools shall offer one or more of the 3 following courses only as a postsecondary educational program: 4 * * * 5 (9) A course of practical training and technical instruction extending over a 6 period of not less than seven consecutive months and including not less than one 7 thousand hours for the basic course of hair design leading to a hair design certificate 8 sufficient to apply for licensure in hair design. Replace the board exam required for a person who possesses a license or certificate of registration to practice as a cosmetologist, esthetician, or manicurist from another state or from a foreign country with the national interstate council of state boards of cosmetology, or NIC, examinations. Add that proposed law also provides to hair designers. 5. Add an examination for hair design to be given at least twice monthly. 6. Require and outline a course for hair design.
