HOUSE BILL NO. 959

LICENSING:  Provides relative to the sunset of licenses
1	AN ACT
2To enact R.S. 3:1.1, R.S. 4:65(D) and 142.1, R.S. 6:1.1, R.S. 32:784(F) and 1254(Q), and
3 R.S. 37:21.1, relative to licenses authorized by certain departments, boards,
4 commissions, and offices; to terminate licenses created or authorized by the Dept.
5 of Agriculture and Forestry, Louisiana State Boxing and Wrestling Commission,
6 Louisiana State Racing Commission, Office of Financial Institutions, Louisiana Used
7 Motor Vehicle Commission, Louisiana Motor Vehicle Commission, Louisiana Board
8 of Examiners of Certified Shorthand Reporters, Louisiana State Polygraph Board,
9 Louisiana Board of Professional Geoscientists, State Board of Certified Public
10 Accountants of Louisiana, Louisiana State Board of Architectural Examiners,
11 Louisiana State Board of Cosmetology, Louisiana Professional Engineering and
12 Land Surveying Board, Louisiana State Plumbing Board, Louisiana Auctioneers
13 Licensing Board, Louisiana State Licensing Board for Contractors, Louisiana State
14 Board of Examiners of Interior Designers, Louisiana State Board of Private Security
15 Examiners, Louisiana Board of Embalmers and Funeral Directors, Louisiana State
16 Board of Private Investigator Examiners, Louisiana Real Estate Appraisers Board,
17 Louisiana Real Estate Commission, and like entities in Title 37 of the Louisiana
18 Revised Statutes of 1950; to terminate professional and occupational licenses in Title
19 37; to exempt certain licenses; and to provide for related matters.
20Be it enacted by the Legislature of Louisiana:

1 Section 1.  R.S. 3:1.1 is hereby enacted to read as follows:
2 §1.1.  Termination of licensure; exceptions 
3	A.  All licenses created and authorized pursuant to the provisions of this Title
4 shall expire on July 1, 2026.
5	B.  The provisions of this Section shall not apply to any of the following: 
6	(1)  Health professionals, healthcare providers and licenses, and the
7 Department of Health and all statutory entities made a part of the department by law.
8	(2)  A license that requires a doctorate degree, whether medical, professional,
9 or otherwise.
10 Section 2.  R.S. 4:65(D) and 142.1 are hereby enacted to read as follows: 
11 §65.  Licenses; fees; bond

13	D.  All licenses created and authorized pursuant to the provisions of this
14 Chapter shall expire on July 1, 2028.  The provisions of this Subsection shall not
15 apply to a license that requires a doctorate degree, whether medical, professional, or
16 otherwise.

18 §142.1.  Termination of licensure; exceptions 
19	A.  All licenses created and authorized pursuant to the provisions of this
20 Chapter shall expire on July 1, 2028.
21	B.  The provisions of this Section shall not apply to any of the following: 
22	(1)  Health professionals and healthcare providers and licenses.
23	(2)  A license that requires a doctorate degree, whether medical, professional,
24 or otherwise.
25 Section 3.  R.S. 6:1.1 is hereby enacted to read as follows: 
26 §1.1.  Termination of licensure; exceptions 
27	A.  All licenses created and authorized pursuant to the provisions of this Title
28 shall expire on July 1, 2030.

1	B.  The provisions of this Section shall not apply a license that requires a
2 doctorate degree, whether medical, professional, or otherwise.
3 Section 4.  R.S. 32:784(F) and 1254(Q) are hereby enacted to read as follows:
4 §784. Dealers, dismantlers, and auctions to be licensed; exception

6	F.  All licenses created and authorized pursuant to the provisions of this
7 Chapter shall expire on July 1, 2028.  The provisions of this Subsection shall not
8 apply to a license that requires a doctorate degree, whether medical, professional, or
9 otherwise.

11 §1254. Application for license; requirements for licensure; contents; licenses;
12	franchise filings; exceptions

14	Q.  All licenses created and authorized pursuant to the provisions of this
15 Chapter shall expire on July 1, 2028.  The provisions of this Subsection shall not
16 apply to a license that requires a doctorate degree, whether medical, professional, or
17 otherwise.
18 Section 5.  R.S. 37:21.1 is hereby enacted to read as follows: 
19 §21.1.  Termination of licensure; exceptions 
20	A.  All licenses created and authorized pursuant to the provisions of this Title
21 shall expire on July 1, 2026.
22	B.  The provisions of this Section shall not apply to any of the following: 
23	(1)  Health professionals, healthcare providers and licenses, and the
24 Department of Health and all statutory entities made a part of the department by law.
25	(2)  Attorneys pursuant to Chapter 4 of this Title. 
26	(3)  A license that requires a doctorate degree, whether medical, professional,
27 or otherwise.

Abstract:  Terminates licensure requirements and licensing for certain professions and
occupations.
Proposed law terminates licenses created and authorized by certain departments, agencies,
boards, and commissions.
Proposed law includes but is not limited to the following entities whose licensing authority
expires on July 1, 2026: 
(1)La. Board of Examiners of Certified Shorthand Reporters
(2)La. State Polygraph Board
(3)La. Board of Professional Geoscientists
(4)La. Board of Embalmers and Funeral Directors
(5)La. Board of Certified Public Accountants
(6)La. Board of Architectural Examiners
(7)La. Board of Cosmetology
(8)La. Professional Engineering and Land Surveying Board
(9)La. Plumbing Board
(10)La. Real Estate Commission 
(11)La. Real Estate Appraisers Board
(12)La. Licensing Board for Contractors
(13)La. Auctioneers Licensing Board
(14)La. Board of Examiners of Interior Designers
(15)La. Board of Private Security Examiners
(16)La. Board of Private Investigator Examiners
(17)La. Dept. of Agriculture and Forestry and statutory entities made a part of the
department by present law
Proposed law further provides that the licensing authority of the following entities expires
on July 1, 2028: 
(1)La. State Boxing and Wrestling Commission

(2)La. Racing Commission
(3)La. Used Motor Vehicle Commission
(4)La. Motor Vehicle Commission
Proposed law further provides that the licensing authority of the Office of Financial
Institutions expires on July 1, 2030. 
Proposed law exempts all of the following from proposed law:
 (1)Health professionals, healthcare providers and licenses, and the Dept. of Health and
all statutory entities made a part of the department by present law.
(2)Attorneys.
(3)A license that requires a doctorate degree.
