2626 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2727 of the same, as follows:
2828 1 SECTION 1. Chapter 94G of the Massachusetts General Laws shall be amended by
2929 2adding after Section 21, the following section:
3030 3 Section 22.
3131 4 (a)The Commission shall collect, compile, and make available to the public on its
3232 5Open Data Platform, the following data from independent testing laboratories as defined in
3333 6Section 15 of this Chapter:
3434 7 Industry average for,
3535 8 a. Failure rates for Pesticides
3636 9 b. Failure rates for Heavy metals
3737 10 c. Failure rates for Microbiological contaminants
3838 11 d. Failure rates for Residual solvents 2 of 3
3939 12 e. Failure rates for Mycotoxins
4040 13 f. Moisture content for flower
4141 14 g. THC + THCA for flower
4242 15 h. THC + THCA for Marijuana Vaporizer Devices
4343 16 i. THC + THCA for concentrates
4444 17 j. Total terpenes for flower
4545 18 k. Total terpenes for concentrates
4646 19 l. Total terpenes for Marijuana Vaporizer Devices
4747 20 Per licensed Independent Testing Laboratory, their average for

6060 33 (b)The initial data report shall include all prior Independent Testing Laboratory data
6161 34submitted to the Commission. The initial report shall be published per Independent Testing
6262 35Laboratory per quarter inclusive of reports. Subsequent data reports shall be updated and
6363 36published on a quarterly basis detailing information from the preceding quarter.
6464 37 (c)The Commission shall investigate and publicly report the reason for the
6565 38discrepancy for individual Independent Testing Laboratories that are statistically significant
6666 39outliers in terms of their testing results.
6767 40 (d)The Commission shall promulgate regulations in accordance with this section no
6868 41later than one year after the effective date of this act.
