The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ An Act relative to data transparency in the cannabis industry. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 SECTION 1. Chapter 94G of the Massachusetts General Laws shall be amended by 2adding after Section 21, the following section: 3 Section 22. 4 (a)The Commission shall collect, compile, and make available to the public on its 5Open Data Platform, the following data from independent testing laboratories as defined in 6Section 15 of this Chapter: 7 Industry average for, 8 a. Failure rates for Pesticides 9 b. Failure rates for Heavy metals 10 c. Failure rates for Microbiological contaminants 11 d. Failure rates for Residual solvents 2 of 3 12 e. Failure rates for Mycotoxins 13 f. Moisture content for flower 14 g. THC + THCA for flower 15 h. THC + THCA for Marijuana Vaporizer Devices 16 i. THC + THCA for concentrates 17 j. Total terpenes for flower 18 k. Total terpenes for concentrates 19 l. Total terpenes for Marijuana Vaporizer Devices 20 Per licensed Independent Testing Laboratory, their average for 21 a. Failure rates for Pesticides 22 b. Failure rates for Heavy metals 23 c. Failure rates for Microbiological contaminants 24 d. Failure rates for Residual solvents 25 e. Total terpenes for Marijuana Vaporizer Devices 33 (b)The initial data report shall include all prior Independent Testing Laboratory data 34submitted to the Commission. The initial report shall be published per Independent Testing 35Laboratory per quarter inclusive of reports. Subsequent data reports shall be updated and 36published on a quarterly basis detailing information from the preceding quarter. 37 (c)The Commission shall investigate and publicly report the reason for the 38discrepancy for individual Independent Testing Laboratories that are statistically significant 39outliers in terms of their testing results. 40 (d)The Commission shall promulgate regulations in accordance with this section no 41later than one year after the effective date of this act.
