Jones, Jr. and others relative to authorizing the courts of the Commonwealth to establish a system of juvenile restitution. The Judiciary. [SIMILAR MATTER FILED IN PREVIOUS SESSION SEE HOUSE, NO. 1684 OF 2021-2022.] The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ An Act relative to juvenile restitution. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 SECTION 1. Chapter 119 of the General Laws, as appearing in the 2020 Official Edition, 2is hereby amended by inserting after section 62 the following new section:- 3 “Section 62A. The court shall make all reasonable efforts to ensure that restitution is 4made to the victim of a juvenile offender. The court shall order that the juvenile be required to 5repair, replace or otherwise make restitution for damage or loss caused by his wrongful act and 6may impose fines in limited amounts. Restitution shall be made a condition of release, 7placement, or parole by the juvenile court. In cases where the court determines it is appropriate, 8the court may order the juvenile to make restitution directly to the court in the form of financial 9payments, which shall then be turned over to the victim of the offense. The court may issue such 2 of 2 10orders as are necessary for the collection of restitution, including garnishments, wage 11withholdings, and executions.”
