The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ An Act relative to eminent domain. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 SECTION 1. Chapter 79 of the General Laws, as appearing in the 2020 Official Edition, 2is hereby amended by inserting after section 1 the following new section: 3 Section 1A. Notwithstanding any general or special law to the contrary, any agreement 4for damages from an eminent domain taking— for private or commercial investment— must 5award a minimum of two hundred percent of fair market value for the parcel of land. 6 SECTION 2. This act shall take effect upon its passage.
