Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 SECTION 1. Section 7 of chapter 4 of the General Laws, so appearing, is hereby 2amended by striking out the sixtieth clause as amended by Section 1 of Chapter 69 of the Acts of 32020, and inserting in place thereof the following clause:- Sixtieth, “Age of criminal majority” 4shall mean the age of “19.” 5 SECTION 2. Said clause of said section 7 of said chapter 4 is further amended by striking 6out the number “19,” inserting in place thereof the following number:- “20” 7 SECTION 3. Section 58 of chapter 119 of the General Laws, as appearing in the 2020 56Official Edition, is hereby amended by striking out the words in lines 8 to 12, inclusive “that any 57such probation may be imposed until such child reaches age eighteen or age nineteen in the case 58of a child whose case is disposed of after he has attained his eighteenth birthday or age 20 in the 59case of a child whose case is disposed of after he attains his nineteenth birthday”, and inserting in 60place thereof the following words:- “that any such probation may, in the case of an offense that 61occurred prior to the child’s eighteenth birthday, be imposed until such child reaches age 18 or 6219 in the case of a child whose case is disposed of after the child has attained the child’s 63eighteenth birthday or age 20 in the case of a child whose case is disposed of after the child 64attains the child’s nineteenth birthday. In the case of an offense that occurred on or after the 65child’s eighteenth birthday, such probation may be imposed until such child reaches age 19 or 66age 20 in the case of a child whose case is disposed of after the child has attained the child’s 67nineteenth birthday, or age 21 in the case of a child whose case is disposed of after the child 68attains the child’s twentieth birthday.” 69 SECTION 18. Section 58 of chapter 119 of the General Laws, as appearing in the 2020 70Official Edition, is hereby amended by inserting after the words “after he attains his twentieth 71birthday”, in line 12, the following words:- “or age 22 in the case of a child whose case is 72disposed of after the child attains the child’s twenty-first birthday” 73 SECTION 19. Section 58 of chapter 119 of the General Laws, as appearing in the 2020 74Official Edition, is hereby further amended by inserting after the words “his twenty-first 75birthday”, in line 12, the following words:- “or age 23 in the case of a child whose case is 76disposed of after the child attains the child’s twenty-second birthday” 5 of 18 77 SECTION 20. Section 58 of chapter 119 of the General Laws, as appearing in the 2020 78Official Edition, is hereby amended by inserting after the words “attains the age of eighteen”, in 79lines 26 to 27, inclusive, the following words:- “in a case where the offense occurred prior to the 80child’s eighteenth birthday.” 81 SECTION 21. Section 58 of chapter 119 of the General Laws, as appearing in the 2020 82Official Edition, is hereby amended by inserting after the words “nineteenth birthday”, in lines 8329 to 30, inclusive, the following words:- “In a case where the offense occurred on or after the 84child’s eighteenth birthday, the probationary or commitment period shall not be for a period 85longer than until such child attains the age of nineteen, or twenty in the case of a child whose 86case is disposed of after such child has attained their nineteenth birthday, or twenty-one in the 87case of a child whose case is disposed of after such child has attained their twentieth birthday.” 88 SECTION 22. Section 58 of chapter 119 of the General Laws, as appearing in the 2020 89Official Edition, is hereby amended by inserting after the words “ twentieth birthday” the 90following words:- “or twenty-two in the case of a child whose case is disposed of after such child 91has attained their twenty-first birthday.” 92 SECTION 23. Section 58 of chapter 119 of the General Laws, as appearing in the 2020 93Official Edition, is hereby amended by inserting after the words “twenty-first birthday”, the 94following words:- “or twenty-two in the case of a child whose case is disposed of after they have 95attained their twenty-first birthday, or twenty-three in the case of a child whose case is disposed 96of after they have attained their twenty-second birthday.” 97 SECTION 24. Section 58 of chapter 119 of the General Laws, as appearing in the 2020 98Official Edition, is hereby amended by inserting after the words “twenty-one”, in line 38, the 6 of 18 99following words:- “in a case where the offense occurred prior to the child’s eighteenth birthday, 100or until he reaches the age of twenty- three in the case of a child whose offense occurred on or 101after the child’s eighteenth birthday.” 102 SECTION 25. Section 58 of chapter 119 of the General Laws, as appearing in the 2020 103Official Edition, is hereby amended by inserting after the words “twenty-one”, in line 54, the 104following words:- “in a case where the offense occurred prior to the child’s eighteenth birthday, 105or until they reach the age of twenty-three in the case of a child whose offense occurred on or 106after the child’s eighteenth birthday” 107 SECTION 26. Section 58 of chapter 119 of the General Laws, as appearing in the 2020 108Official Edition, is hereby amended by inserting after the words “juvenile court probation 109department until the age of twenty-one”, in line 48, the following words:- “in a case where the 110offense occurred prior to the child’s eighteenth birthday, or until the age of twenty-three in the 111case of a child whose offense occurred on or after the child’s eighteenth birthday.” 112 SECTION 27. Section 58 of chapter 119 of the General Laws, as appearing in the 2020 113Official Edition, is hereby amended by inserting after the words “twenty-one”, in line 54, the 114following words:- “in a case where the offense occurred prior to the child’s eighteenth birthday, 115or until they reach the age of twenty-three in the case of a child whose offense occurred on or 116after the child’s eighteenth birthday” 117 SECTION 28. Section 58 of chapter 119 of the General Laws, as appearing in the 2020 118Official Edition, is hereby amended by striking out the word “eighteenth”, in line 79, and 119inserting in place thereof the following words:- “twenty-first” 7 of 18 120 SECTION 29. Section 58 of chapter 119 of the General Laws, as appearing in the 2020 132Official Edition, is hereby amended by striking out the words “until such child attains his 133eighteenth birthday or his nineteenth birthday in the case of a child whose case is disposed of 134after he has attained his eighteenth birthday”, in lines 97 to 99, inclusive, and inserting the 135following words:- “until such child attains their nineteenth birthday or their twentieth birthday in 136the case of a child whose case is disposed of after they have attained their nineteenth birthday” 137 SECTION 31. Subsection (b) of section 72 of chapter 119 of the General Laws, as 211appearing in the 2020 Official Edition, is hereby amended by striking out the words “their 212eighteenth birthday”, in line 18, and inserting in place thereof the following words:-the age of 213criminal majority 214 SECTION 51. Section 100D of chapter 276 of the General Laws, as appearing in the 3442020 Official Edition, is hereby amended by striking out in line 8 the number “17” and inserting 345in place thereof the following words:- “criminal majority” 346 SECTION 88. Section 6B of chapter 280 of the General Laws, as so appearing, is hereby 347amended by striking out in the first paragraph as amended by section 209 of chapter 69 of the 348Acts of 2020, the words “18 years” and inserting in place thereof the following words:- “criminal 349majority” 18 of 18 350 SECTION 89. Sections 1, 30, and 46 are hereby repealed. 351 SECTION 90. Section 89 shall take effect on July 1, 2026. 352 SECTION 91. Sections 2, 31, and 47 shall take effect on July 1, 2026. 353 SECTION 92. Sections 18 and 22, shall take effect on July 1, 2026. 354 SECTION 93. Section 91 is hereby repealed. 355 SECTION 94. Section 93 shall take effect on July 1, 2028. 356 SECTION 95. Sections 3, 19, 23, 32, and 48 shall take effect on July 1, 2028.
