2828 An Act relative to indecent assault and battery.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 SECTION 1. Section 13B of chapter 265 of the General Laws, as appearing in the 2020
3232 2Official Edition, is hereby amended by inserting after the first paragraph the following 2
3333 3paragraphs:-
3434 4 For the purposes of this section, “bodily substance” shall mean any human secretion,
3535 5discharge or emission including, but not limited to, blood, saliva, mucous, semen, urine or feces.
3636 6 Indecent assault and battery on a child under the age of 14 shall include assault on said
3737 7child by a bodily substance.
3838 8 SECTION 2. Section 13B ½ of said chapter 265, as so appearing, is hereby amended by
3939 9inserting after the first paragraph the following 2 paragraphs:- 2 of 3
4040 10 For the purposes of this section, “bodily substance” shall mean any human secretion,
4141 11discharge or emission including, but not limited to, blood, saliva, mucous, semen, urine or feces.
4242 12 Said indecent assault and battery shall include assault on said child by a bodily substance.
4343 13 SECTION 3. Section 13B ¾ of said chapter 265, as so appearing, is hereby amended by
4444 14inserting after the first paragraph the following 2 paragraphs:-
4545 15 For the purposes of this section, “bodily substance” shall mean any human secretion,
4646 16discharge or emission including, but not limited to, blood, saliva, mucous, semen, urine or feces.
4747 17 Indecent assault and battery on a child under the age of 14 shall include assault on said
4848 18child by a bodily substance.
4949 19 SECTION 4. Section 13F of said chapter 265, as so appearing, is hereby amended by
5050 20adding the following 2 paragraphs:-
5151 21 For the purposes of this section, “bodily substance” shall mean any human secretion,
5252 22discharge or emission including, but not limited to, blood, saliva, mucous, semen, urine or feces.
5353 23 Indecent assault and battery on a person with an intellectual disability shall include
5454 24assault on said person by a bodily substance.
5555 25 SECTION 5. Section 13H of said chapter 265, as so appearing, is hereby amended by
5656 26adding the following 2 paragraphs:-
5757 27 For the purposes of this section, “bodily substance” shall mean any human secretion,
5858 28discharge or emission including, but not limited to, blood, saliva, mucous, semen, urine or feces. 3 of 3
5959 29 Indecent assault and battery on a person 14 or older, or an elder or a person with a
6060 30disability shall include assault said person by a bodily substance.
