An Act relative to indecent assault and battery.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority 
of the same, as follows:
1 SECTION 1. Section 13B of chapter 265 of the General Laws, as appearing in the 2020 
2Official Edition, is hereby amended by inserting after the first paragraph the following 2 
3paragraphs:-
4 For the purposes of this section, “bodily substance” shall mean any human secretion, 
5discharge or emission including, but not limited to, blood, saliva, mucous, semen, urine or feces.
6 Indecent assault and battery on a child under the age of 14 shall include assault on said 
7child by a bodily substance.
8 SECTION 2. Section 13B ½ of said chapter 265, as so appearing, is hereby amended by 
9inserting after the first paragraph the following 2 paragraphs:- 2 of 3
10 For the purposes of this section, “bodily substance” shall mean any human secretion, 
11discharge or emission including, but not limited to, blood, saliva, mucous, semen, urine or feces.
12 Said indecent assault and battery shall include assault on said child by a bodily substance.
13 SECTION 3. Section 13B ¾ of said chapter 265, as so appearing, is hereby amended by 
14inserting after the first paragraph the following 2 paragraphs:-
15 For the purposes of this section, “bodily substance” shall mean any human secretion, 
16discharge or emission including, but not limited to, blood, saliva, mucous, semen, urine or feces.
17 Indecent assault and battery on a child under the age of 14 shall include assault on said 
18child by a bodily substance.
19 SECTION 4. Section 13F of said chapter 265, as so appearing, is hereby amended by 
20adding the following 2 paragraphs:-
21 For the purposes of this section, “bodily substance” shall mean any human secretion, 
22discharge or emission including, but not limited to, blood, saliva, mucous, semen, urine or feces.
23 Indecent assault and battery on a person with an intellectual disability shall include 
24assault on said person by a bodily substance.
25 SECTION 5. Section 13H of said chapter 265, as so appearing, is hereby amended by 
26adding the following 2 paragraphs:-
27 For the purposes of this section, “bodily substance” shall mean any human secretion, 
28discharge or emission including, but not limited to, blood, saliva, mucous, semen, urine or feces. 3 of 3
29 Indecent assault and battery on a person 14 or older, or an elder or a person with a 
30disability shall include assault said person by a bodily substance.
